RESOLUTION 2015-18 <br />APPROVING A VARIANCE TO ALLOW CONSTRUCTION OF A HOUSE <br />WITHIN THE SHORELAND SETBACK REQUIREMENT ON HORSESHOE <br />LAKE FOR PROPERTY LOCATED SOUTH OF 174TH STREET AND EAST OF <br />GREYSTONE AVENUE NORTH <br />WHEREAS, Christopher and Torrie Johnson, have requested a variance to locate a house <br />125 feet from the ordinary high water (OHW) mark of Horseshoe Lake, at the closest, <br />where a 200 foot setback is required by ordinance, on the property legally described as: <br />(See attached) <br />WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed the variance at <br />a duly called public hearing on Thursday, April 2, 2015, and recommended approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF HUGO, MINNESOTA, that it should and hereby does approve the variance <br />request to construct a house 125 feet from the ordinary high water (OHW) mark of <br />Horseshoe Lake, where 200 feet is required by ordinance, with the following findings: <br />The requested variance is from the dimensional requirement of the ordinance and <br />is permissible by law. <br />2. Because of circumstances unique to the property there are practical difficulties on <br />meeting the ordinance. <br />3. The granting of the variance would be in keeping with the spirit and intent of the <br />ordinance. <br />4. The applicant is proposing to use the property in a reasonable manner and <br />construction of a house is allowed in the FUS zoning district. <br />5. The proposed variance would not noticeably alter the character to the average <br />person. <br />6. Houses are a permitted use in the FUS District. <br />The subject property is not within a floodplain. <br />8.
