- -, <br />CITY OF HUGO <br />ORDINANCE 2009-433 <br />AN ORDINANCE AMENDING CHAPTER 50, SECTION 50-1 Shooting <br />Regulations <br />THE CITY OF HUGO ORDAINS: <br />Section 1. The City Council of the City of Hugo does hereby amend <br />Chapter 50, Section 50-1, amend the following: <br />Chapter 50, Sec. 50-1. Shooting regulations. <br />(a) Purpose. It is the purpose of the city council in passing the ordi- <br />nance from which this article is derived to provide that the shooting of <br />firearms within the icity limits will not constitute an unreasonable nui- <br />sance to persons in the city. This section is designed to prevent nui- <br />sances caused by the noise created from the discharge of firearms, and <br />to minimize the potential that projectiles discharged from firearms could <br />injure individuals. The city council deems these regulations necessary to <br />protect public and private property and to promote health, safety, order, <br />convenience, and the general welfare of persons within the city. <br />(b) Firing of firearms prohibited; exceptions. No person shall fire or dis- <br />charge guns or firearms of any kind within the limits of any city road, <br />county road, public park, or other city property, or on any occupied <br />private property except with the consent of the owner or legal occupant <br />thereof; provided, however, that this chapter shall not apply to the law- <br />ful defense of persons or property, or in the necessary enforcement of <br />the laws, or for trapshooting on premises owned or controlled by any <br />duly incorporated social organization, or when ordered by the military <br />authority. <br />(c) Hunting with firearms in certain areas. <br />(1) A person may not take a wild animal with a firearm within 500 feet of <br />a building occupied by a human or livestock anywhere with the city. <br />(2) A person may not take a wild animal with a firearm without the per- <br />mission of the owner occupant, or lessee, within 500 feet of a stockade <br />or corral containing livestock anywhere with the city. <br />(d) Penalty. Any person violating the provisions of this chapter shall be <br />guilty of a misdemeanor. <br />(e) The discharge of a firearm is prohibited within the limits of the ordi- <br />nary high water mark on Bald Eagle Lake. <br />Section 2. Severability. In the event that a court of competent jurisdic- <br />tion adjudges any part of this Ordinance to be invalid, such judgment <br />shall not affect any other provision of this Ordinance not specifically in- <br />cluded with that judgment. <br />Section 3. Effective Date.
