- -, CITY OF HUGO ORDINANCE 2009-433 AN ORDINANCE AMENDING CHAPTER 50, SECTION 50-1 Shooting Regulations THE CITY OF HUGO ORDAINS: Section 1. The City Council of the City of Hugo does hereby amend Chapter 50, Section 50-1, amend the following: Chapter 50, Sec. 50-1. Shooting regulations. (a) Purpose. It is the purpose of the city council in passing the ordi- nance from which this article is derived to provide that the shooting of firearms within the icity limits will not constitute an unreasonable nui- sance to persons in the city. This section is designed to prevent nui- sances caused by the noise created from the discharge of firearms, and to minimize the potential that projectiles discharged from firearms could injure individuals. The city council deems these regulations necessary to protect public and private property and to promote health, safety, order, convenience, and the general welfare of persons within the city. (b) Firing of firearms prohibited; exceptions. No person shall fire or dis- charge guns or firearms of any kind within the limits of any city road, county road, public park, or other city property, or on any occupied private property except with the consent of the owner or legal occupant thereof; provided, however, that this chapter shall not apply to the law- ful defense of persons or property, or in the necessary enforcement of the laws, or for trapshooting on premises owned or controlled by any duly incorporated social organization, or when ordered by the military authority. (c) Hunting with firearms in certain areas. (1) A person may not take a wild animal with a firearm within 500 feet of a building occupied by a human or livestock anywhere with the city. (2) A person may not take a wild animal with a firearm without the per- mission of the owner occupant, or lessee, within 500 feet of a stockade or corral containing livestock anywhere with the city. (d) Penalty. Any person violating the provisions of this chapter shall be guilty of a misdemeanor. (e) The discharge of a firearm is prohibited within the limits of the ordi- nary high water mark on Bald Eagle Lake. Section 2. Severability. In the event that a court of competent jurisdic- tion adjudges any part of this Ordinance to be invalid, such judgment shall not affect any other provision of this Ordinance not specifically in- cluded with that judgment. Section 3. Effective Date. This amendment shall take effect upon its passage and publication. ADOPTED BY THE HUGO CITY COUNCIL ON SEPTEMBER 8, 2009.
