ORDINANCE 2008-420 <br />AN ORDINANCE AMENDING CHAPTER 320 (COMPREHENSIVE LAND USE <br />REGULATION) TO ADD SECTION 1195-365.1 JUNK VEHICLES AND REPEALING <br />CHAPTER 200, SECTION 4, NUMBER 17 REGARDING JUNK VEHICLES <br />THE CITY OF HUGO ORDAINS: <br />Section 1. The City Council of the City of Hugo does hereby repeal Chapter 200, Section 4, Number <br />17, and add Section 1195.365.1, Junk Vehicles, of the Hugo City Comprehensive Land Use Regulations <br />to state the following: <br />Subd. 1 Junk vehicles, or parts thereof, parked or stored on any public or private property that <br />are not housed in a building shall be declared a public nuisance. For the purpose of this section <br />"junk vehicle" shall mean any motor vehicle which is not in operable condition, partially <br />dismantled, used for a source of repair or replacement parts for other vehicles, kept for <br />scrapping, dismantling, or salvage of any kind, or which is not properly licensed for operation <br />within the state. <br />Subd. 2 Property meeting any of the following criteria shall be allowed no more than two junk <br />vehicles parked or stored on the property provided that the junk vehicle is screened from <br />adjacent properties and is not parked on the grass in the front yard: <br />(A) Property that is zoned Rural Residential, Future Urban Service, Agricultural, or Long <br />Term Agricultural and includes an inhabited dwelling, or; <br />(B) Property in any urban residential zoning district that is 10 acres or more and includes <br />an inhabited dwelling. <br />Section 2. Severability. In the event that a court of competent jurisdiction adjudges any part of this <br />Ordinance to be invalid, such judgment shall not affect any other provision of this Ordinance not <br />specifically included with that judgment. <br />Section 3. Effective Date.
