ORDINANCE NO. 2005-399 <br />AN ORDINANCE OF THE CITY OF HUGO, WASHINGTON COUNTY, MINNESOTA, <br />AMENDING HUGO COMPREHENSIVE LAND USE REGULATIONS SECTION 1195- <br />370.1 ON KENNELS -COMMERCIAL AND SECTION 1135-040.1 ON CONDITIONAL <br />USES IN THE GENERAL INDUSTRIAL ZONING DISTRICT <br />Section 1. The City Council of the City of Hugo does hereby amend Section 1195-370.1 <br />Kennels -Commercial, of the Hugo Comprehensive Land Use Regulations shall read as follows: <br />1195-370.1 KENNELS -COMMERCIAL: <br />Subd. 2 Commercial kennels may be allowed as a principal use only in the <br />Long -Term Agriculture, General Industrial, and Restricted Commercial Zoning <br />Districts by Conditional Use Permit. <br />Subd. 5 All structures, pens, fences, or other materials used for the <br />confinement, care, or breeding of animals, shall be setback a minimum of one <br />hundred (100) feet from any residential property line and fifty (50) feet from any <br />water supply well. <br />Section 2. The City Council of the City of Hugo does hereby amend Section 1135-040.1 <br />General Industrial District Conditional Uses, of the Hugo Comprehensive Land Use Regulations <br />by adding the following subdivision: <br />1135-040.1 CONDITIONAL USES: <br />Subd. 19 All Kennels, Commercial (refer to Section 1195-370.1) <br />Section 3. Severability. In the event that a court of competent jurisdiction adjudges any <br />part of this Ordinance to be invalid, such judgment shall not affect any other provision of this <br />Ordinance no specifically included within that judgment. <br />Section 4. Effective Date.
