<br />The City Council of the City of Hugo, Washington County, Minnesota, does hereby
<br />ordain as follows:
<br />WHEREAS, the City has been advised of a new recycling program that provides for
<br />single -sort residential recycling. Single -sort recycling allows customers to mix targeted
<br />recyclables in one collection bin. The mixed recyclables are collected and taken to a
<br />recycling center for sorting. Single -sort recycling is made possible through the use of
<br />various mechanized screens and optical sorting technologies in the recycling plants;
<br />and
<br />WHEREAS, the City has been advised residential single -sort programs have great-
<br />ly increased the recycling rates, recovering as much as three times the amount of recy-
<br />clable materials. The increase in the recycling occurs because single -sort recycling is
<br />easier for individuals because paper items, bottles and cans are commingled in the
<br />recycle cart on site and later sorted at the recycling center; and
<br />WHEREAS, single -sort residential recycling programs utilize large recycling carts
<br />on wheels that do not require weekly recyclable pick upand
<br />WHEREAS, the City's current recycling ordinance, Ordinance 1994-293, Chapter
<br />;
<br />120, Section 12 of the City Code provides for weekly collection of recyclables; and
<br />WHEREAS, the City Council desires to amend the recycling ordinance to allow for
<br />bi-weekly collection of recyclables which will allow residents to participate in the new
<br />single -sort residential recycling programs that utilizes bi-weekly collection of recy-
<br />clables.
<br />NOW THEREFORE, it is hereby ordained by the City Council of the City of Hugo,
<br />Washington County, Minnesota as follows:
<br />Section 1. Chapter 120, Section 12 of the City Code of the City of Hugo iE
<br />hereby amended to delete the following language, "Each licensed MSW hauler shal
<br />provide its customers with an opportunity to recycle through weekly collections of tar
<br />geted recyclables" and replace it with the following language: "Each licensed MSN
<br />hauler shall provide its customers with an opportunity to recycle through weekly or bi
<br />weekly collections of targeted recyclables"
<br />Section 2. Severability. In the event that a court of competent jurisdictioi
<br />adjudges any part of this Ordinance to be invalid, such judgment shall not affect an;
<br />other provision of this Ordinance not specifically included within that judgment.
<br />Section 3. Effective Date. This Ordinance shall be in full force and effec
