ORDINANCE NO. 2002-364 <br />AN ORDINANCE OF THE CITY OF HUGO, WASHINGTON COUNTY, MINNESOTA, <br />AMENDING SECTION 1195-365 OF THE HUGO COMPREHENSIVE LAND USE <br />REGULATIONS BY ESTABLISHING STANDARDS FOR INDOOR RIDING ARENAS <br />Section 1. The City Council of the City of Hugo does hereby amend Section 195-365 of <br />the Hugo Comprehensive Land Use Regulations by adding the following: <br />1195-365.1 INDOOR RIDING ARENAS. It is unlawful for any person to construct or operate <br />a indoor riding arena, except in conformance with this ordinance. <br />Subd. 1. Indoor riding arenas shall be allowed as a permitted use in the <br />Agricultural, Rural Residential, and Future Urban Reserve zoning districts on parcels <br />twenty (20) acres or more in size. <br />Subd. 2. Indoor riding arenas may be allowed by conditional use permit in the <br />Agricultural, Rural Residential, and Future Urban Reserve zoning districts on parcels at <br />least ten (10) acres in size, subject to the following conditions: <br />(A) The riding arena may not exceed 8,400 square feet in size. Other agricultural and <br />accessory buildings may be constructed on the property or attached to the riding <br />arena provided the size of the structures do not exceed the permitted square <br />footage outlined in Section 1195-030.1 of this ordinance. <br />(B) The riding arena may not be located between the home and a public street. <br />(C) Not more than 25 percent of the structure can contain a concrete floor or other <br />similar surface. <br />(D) The riding arena shall be a minimum of 40 feet from the side lot line and meet all <br />other applicable setback requirements. <br />(E) If the use of the riding arena is discontinued in the future, the building may not be <br />used for the operation of a business, including the storage of business related <br />materials and equipment. <br />(F) The keeping of animals and construction of other horse related facilities shall <br />comply with Section 1195-340 and 1195-420 of the ordinance. <br />Section 2. Severability. In the event that a court of competent jurisdiction adjudges any <br />part of this Ordinance to be invalid, such judgment shall not affect any other provision of this <br />Ordinance no specifically included within that judgment. <br />
