PRINTER'S AFFIDAVIT OF PUBLICATION <br />CITY OF HUGO <br />ORDINANCE NO. 2002-364 <br />NN ORDINANCE OF THE CITY OF <br />.30, WASHINGTON COUNTY, MIN- <br />NESOTA, <br />AMENDING SECTION 1195-365 OF <br />THE HUGO COMPREHENSIVE LAND <br />USE REGULATIONS BY ESTABLISH- <br />ING STANDARDS FOR INDOOR RID- <br />ING ARENAS <br />Section 1. The City Council of the <br />City of Hugo does hereby amend Section <br />195-365 of the Hugo Comprehensive <br />Land Use Regulations by adding the fol- <br />lowing: <br />1195-365.1 INDOOR RIDING ARE- <br />NAS. It is unlawful for any person to con- <br />struct or operate a indoor riding arena, <br />except in conformance with this ordi- <br />nance. <br />Subd. 1. Indoor riding are- <br />nas shall be allowed as a permitted use in <br />the Agricultural, Rural Residential, and <br />Future Urban Reserve zoning districts on <br />parcels twenty (20) acres or more in size. <br />Subd.2. Indoor riding are- <br />nas may be allowed by conditional use <br />permit in the Agricultural, Rural <br />Residential, and Future Urban Reserve <br />zoning districts on parcels at least ten <br />(10) acres in size, subject to the following <br />conditions: <br />(A) The riding arena may not exceed <br />12,000 square feet in size, including <br />attached stables and storage areas. <br />(B) The riding arena may not be locat- <br />ed between the home and a public street. <br />(C) Not more than 50 percent of the <br />structure can contain a concrete floor or <br />ar similar surface. <br />(D) The riding arena shall be a mini- <br />_rn of 40 feet from the side lot line and <br />meet all other applicable. setback require- <br />ments. <br />(E) If the use of the riding arena is <br />discontinued in the future, the building <br />may not be used for the operation of a <br />business, including the storage of busi- <br />ness related materials and equipment. <br />(F) The keeping of animals and con- <br />struction of other horse related facilities <br />shall comply with Section 1195-340 and <br />1195-420 of the ordinance. <br />Section 2. Severability. In the event <br />that a court of competent jurisdiction <br />adjudges any part of this Ordinance to be <br />invalid, such judgment shall not affect any <br />other provision of this Ordinance no <br />specifically included within that judgment. <br />Section 3. Effective Date.
