PRINTER'S AFFIDAVIT OF PUBLICATION <br />CITY OF HUGO <br />ORDINANCE NO. 2001-348 <br />AN ORDINANCE OFTHE CITY OF HUGO, <br />WASHINGTON COUNTY, MINNESOTA, <br />AMENDING CHAPTER 314 OF THE HUGO <br />CITY CODE PERTAINING TO WATER <br />SYSTEMS WITHIN THE CITY BY REQUIRING <br />AN OWNER OF PROPERTY TO PERMIT THE <br />CITY TO ACCESS THEIR PROPERTY TO <br />INSTALL, INSPECT, REPLACE OR REPAIR <br />WATER METERS AND PROVIDING FOR <br />ESTABLISHMENT OF A SURCHARGE FOR <br />NONCOMPLIANCE WITH THIS ORDINANCE. <br />THE CITY COUNCIL OF THE CITY OF <br />HUGO, WASHINGTON COUNTY, MINNESOTA, <br />DOES HEREBY ORDAIN AS FOLLOWS: <br />Section 1. To existing City Code Chapter <br />314, add the following as "§ 314-11(A): Any <br />owner of property or structure connected to the <br />City water system shall allow access to the prop- <br />erty by authorized City employees or agents to <br />install inspect, repair or replace water meters on <br />the property." <br />Section 2. To existing City Code Chapter <br />314, add the following as "Section 314-11(B): A <br />surcharge as established by resolution of the <br />City Council is imposed and shall be added to <br />every water billing mailed on or after June 1, <br />2001, to properties not in compliance with this <br />section. The surcharge shall be added to every <br />billing until the property is in compliance. <br />Compliance shall occur through inspection by <br />authorized City employees or agents of all prop- <br />erties or structures connected to the municipal <br />water system. Any person refusing to allow their <br />property to be inspected shall immediately <br />become subject to the surcharge and the sur- <br />charge shall continue thereafter and be added to <br />every billing until the City confirms compliance:' <br />Section 3. If any portion of this Ordinance is <br />for any reason held invalid or unconstitutional <br />such portion shall be deemed a separate, dis- <br />tinct and independent provision and such hold- <br />ing shall not effect the validity of the remaining <br />portions thereof. <br />Section 4.
