PRINTER'S AFFIDAVIT OF PUBLICATION <br />CITY OF HUGO <br />WASHINGTON COUNTY, MINNESOTA <br />ORDINANCE NO. 2001 - 349 <br />1 ORDINANCE AMENDING CHAPTER 320 <br />ONING ORDINANCE) OF THE CITY CODE <br />BY ALLOWING RETAIL AND WHOLESALE <br />GREENHOUSES IN THE GENERAL <br />BUSINESS ZONING DISTRICT <br />(SIXTH AMENDMENT TO CHAPTER 320) <br />THE CITY OF HUGO ORDAINS: <br />Amendment of City Code. Hugo City Code, <br />Chapter 320, Section 6.52 and 6.53 is hereby <br />deleted in their entirety and replaced with the fol- <br />lowing: <br />6.52 Plant Nurseries. Retail. It is unlawful for <br />any person to construct, operate, or maintain a <br />retail plant nursery, except in conformance with <br />this ordinance. <br />A. Retail plant nurseries are permitted as <br />accessory uses in the Central Business and <br />General Business <br />Zoning Districts. Plant nurseries may be <br />allowed as a principal or accessory use in the <br />Agricultural Zoning District, or as a principal use <br />in the General Business Zoning District by <br />Conditional Use Permit. <br />B. Retail sales of the plants grown on-site <br />are permitted, except that retail sales in the <br />Agricultural Zoning District will only be allowed if <br />the principal road access to the site is a state <br />highway, county road, or City collector street. <br />C. Retail sales of materials brought in from <br />off-site are allowed in the Central Business and <br />General Business Zoning Districts. Such sales <br />may be allowed in the Agricultural Zoning District <br />by Conditional Use Permit. <br />6.53 Plant Nurseries Wholesale It is unlaw- <br />ful for any person to construct, operate, or main- <br />tain a wholesale plant nursery, except in confor- <br />mance with this ordinance. <br />A. Wholesale plant nurseries that do not <br />ide the import, storage, processing, and dis- <br />ition of plants and materials grown off-site <br />a permitted principal and accessory use in <br />the Agricultural and Rural Residential zoning <br />districts. The import, storage, processing, and <br />distribution of plant materials grown off-site may <br />be allowed in the Agricultural zoning district by <br />Conditional Use Permit, and are allowed as a <br />principal or accessory use in the Industrial zon- <br />ing district. <br />B. Wholesale plant nurseries that do not <br />include the import, storage, processing, and dis- <br />tribution of plants and materials grown off-site <br />are a conditional use in the General Business <br />zoning district, subject to the following conditions <br />and standards: <br />1) The City Council may require a greater <br />front yard setback in order to insure that the pro- <br />posed greenhouse structures are compatible <br />with the City's Comprehensive Plan and adja- <br />cent land uses. <br />2) Adequate parking and truck loading and <br />maneuvering areas shall be provided on the site. <br />3) On site storage and use of pesticides and <br />fertilizers shall meet the standards of the <br />Minnesota Department of Agriculture. A chemi- <br />cal storage plan shall be provided to the Zoning <br />Administrator at the time of application for a con- <br />ditional use permit to provide the City with the <br />location, type, amount, and storage method of <br />pesticides, chemicals, and fertilizers kept on the <br />site. <br />C. Operation of a landscaping business is <br />not incidental to operation of a wholesale plant <br />nursery, and only equipment and machinery <br />actively used and maintained for the principal <br />purpose of cultivating plants grown on site, or as <br />°-wed by the principal use of the property, may <br />stored or maintained on the site of a plant <br />ery. <br />D.
