the Metropolitan Urban Service Area tend to be <br />larger lots and, therefore, the density issues are <br />not brought into play. <br />Additionally, in the last four (4) years, the <br />City has had a total of only two (2) building per- <br />mits issued in the City for commercial or indus- <br />trial properties. In comparison, the following is <br />a list of permits issued for single-family devel- <br />opment purposes <br />1988-54 <br />1989-47 <br />1990-51 <br />1991 -67 <br />1992-66 <br />1993-88 <br />1994-80 <br />1995-99 <br />1996-64 <br />1997-18 <br />1998-32 <br />1999 (through May 24) - 80 <br />In addition to the eighty (80) single-family <br />residential building permits already issued in <br />1999, there are approximately 1,000 more <br />which are working their way through the sys- <br />tem. Accordingly, it is the belief of the City <br />Council that residential development is the only <br />type of development that needs to be curtailed <br />during the time of this study. Simply stated, <br />other forms of development are so de minimis <br />that they have no real affect upon the issues <br />being studied during the term of the moratori- <br />um. <br />Section 3. Authority, Minnesota Statutes <br />§462.355, Subd. 4 permits the adoption of <br />interim zoning ordinances for the purpose of <br />protecting the planning process and the health, <br />safety and welfare of its citizens. <br />Section 4. Conclusions. The City Council <br />finds that it is necessary in order to protect the <br />health, safety and welfare of its citizens, to pro- <br />tect the planning process, to conduct the stud- <br />ies described above, and to place a moratori- <br />um on residential development within the <br />MUSA during the term of the studies. <br />Section 5. Development Moratorium y <br />A. A study is hereby authorized and direct- <br />ed to be conducted by the City staff to <br />study and decide how the City should <br />amend its official controls with respect <br />to those items addressed herein. Upon <br />finishing the studies, the City Council <br />shall review the matter and make such <br />decisions as are in the best interests of <br />the City of Hugo. <br />B. Pending completion of the studies and <br />adoption of any amendments to the <br />City's official controls, it shall be unlaw- <br />ful for any person to subdivide residen- <br />tial land within the Metropolitan Urban <br />Service Area of the City of Hugo. <br />Additionally, during the period of time of <br />the moratorium, no applications shall be <br />processed and no land use approvals <br />shall be considered or issued for subdi- <br />vision until the studies referenced herein <br />are completed and the City Council has <br />made a decision as to the "official con- <br />trols." <br />C. For the purposes of the moratorium, the <br />term "residential subdivision" shall be <br />defined in the Hugo City Code to include <br />both major and minor subdivisions. <br />D. That the Council recognizes that they do <br />not possess, individually, the expertise <br />necessary to address each of these <br />study areas. Accordingly, City Staff is <br />hereby directed to recommend the hiring <br />of those experts which will assist the <br />City in property analyzing and studying <br />the issues described herein. <br />Section 6. Exceptions. This moratorium <br />shall not apply to: <br />A. The lawful use of an existing subdivision. <br />B. Construction, location or development of <br />subdivisions which have received all <br />necessary permits and approvals, or <br />have received preliminary plat approval <br />from the City prior to the date of the <br />approval of this Ordinance. <br />C. The creation of cemetery lots. <br />D. Subdivisions resulting from court orders, <br />or the adjustment of a lot line by the <br />movement of a common boundary. <br />E. Subdivisions that are entirely outside of <br />the 2020 Metropolitan Urban <br />Development Area. <br />F. Commercial or industrial developments. <br />Section 7. Enforcement. The City may <br />enforce any provisions of this Ordinance by <br />mandamus, injunction or any other appropriate <br />civil remedy in any court of competent jurisdic- <br />tion. <br />Section 8. Term. Unless earlier terminated <br />by action of the City Council, this Ordinance <br />shall be effective for twelve (12) months from <br />its effective date and may be further extended <br />for such additional periods as the City Council <br />may deem appropriate, not exceeding a total <br />additional period of eighteen (18) months. <br />Section 9. Effective Date. This Ordinance <br />shall be effective immediately upon its passage <br />and publication according to law. <br />WHEREUPON, said Ordinance was <br />declared passed and adopted this 2nd day of <br />August, 1999. <br />Walter L.
