Additionally, in the last four (4) years, the City has had a total of only two (2) building per- mits issued in the City for commercial or indus- trial properties. In comparison, the following is a list of permits issued for single-family devel- opment purposes 1988-54 1989-47 1990-51 1991 -67 1992-66 1993-88 1994-80 1995-99 1996-64 1997-18 1998-32 1999 (through May 24) - 80 In addition to the eighty (80) single-family residential building permits already issued in 1999, there are approximately 1,000 more which are working their way through the sys- tem. Accordingly, it is the belief of the City Council that residential development is the only type of development that needs to be curtailed during the time of this study. Simply stated, other forms of development are so de minimis that they have no real affect upon the issues being studied during the term of the moratori- um. Section 3. Authority, Minnesota Statutes §462.355, Subd. 4 permits the adoption of interim zoning ordinances for the purpose of protecting the planning process and the health, safety and welfare of its citizens. Section 4. Conclusions. The City Council finds that it is necessary in order to protect the health, safety and welfare of its citizens, to pro- tect the planning process, to conduct the stud- ies described above, and to place a moratori- um on residential development within the MUSA during the term of the studies. Section 5. Development Moratorium y A. A study is hereby authorized and direct- ed to be conducted by the City staff to study and decide how the City should amend its official controls with respect to those items addressed herein. Upon finishing the studies, the City Council shall review the matter and make such decisions as are in the best interests of the City of Hugo. B. Pending completion of the studies and adoption of any amendments to the City's official controls, it shall be unlaw- ful for any person to subdivide residen- tial land within the Metropolitan Urban Service Area of the City of Hugo. Additionally, during the period of time of the moratorium, no applications shall be processed and no land use approvals shall be considered or issued for subdi- vision until the studies referenced herein are completed and the City Council has made a decision as to the "official con- trols." C. For the purposes of the moratorium, the term "residential subdivision" shall be defined in the Hugo City Code to include both major and minor subdivisions. D. That the Council recognizes that they do not possess, individually, the expertise necessary to address each of these study areas. Accordingly, City Staff is hereby directed to recommend the hiring of those experts which will assist the City in property analyzing and studying the issues described herein. Section 6. Exceptions. This moratorium shall not apply to: A. The lawful use of an existing subdivision. B. Construction, location or development of subdivisions which have received all necessary permits and approvals, or have received preliminary plat approval from the City prior to the date of the approval of this Ordinance. C. The creation of cemetery lots. D. Subdivisions resulting from court orders, or the adjustment of a lot line by the movement of a common boundary. E. Subdivisions that are entirely outside of the 2020 Metropolitan Urban Development Area. F. Commercial or industrial developments. Section 7. Enforcement. The City may enforce any provisions of this Ordinance by mandamus, injunction or any other appropriate civil remedy in any court of competent jurisdic- tion. Section 8. Term. Unless earlier terminated by action of the City Council, this Ordinance shall be effective for twelve (12) months from its effective date and may be further extended for such additional periods as the City Council may deem appropriate, not exceeding a total additional period of eighteen (18) months. Section 9. Effective Date. This Ordinance shall be effective immediately upon its passage and publication according to law.
