Section 4. Conclusions. The City Council finds that it is <br />necessary in order to protect the health, safety and welfare of its <br />citizens, to protect the planning process, to conduct the studies <br />described above, and to place a moratorium on residential <br />development within the MUSA during the term of the studies.. <br />Section 5. Development Moratorium. <br />A. A study is hereby authorized and directed to be conducted <br />by the City staff to study and decide how the City should <br />amend its official controls with respect to those items <br />addressed herein. Upon finishing the studies, the City <br />Council shall review the matter and make such decisions <br />as are in the best interests of the City of Hugo. <br />B. Pending completion of the studies and adoption of any <br />amendments to the City's official controls, it shall be <br />unlawful for any person to subdivide residential land <br />within the Metropolitan Urban Service Area of the City of <br />Hugo. Additionally, during the period of time of the <br />moratorium, no applications shall be processed and no <br />land use approvals shall be considered or issued for <br />subdivision until the studies referenced herein are <br />completed and the City Council has made a decision as to <br />the "official controls." <br />C. For the purposes of the moratorium, the term "residential <br />subdivision" shall be defined in the Hugo City Code to <br />include both major and minor subdivisions. <br />D. That the Council recognizes that they do not possess, <br />individually, the expertise necessary to address each of <br />these study areas. Accordingly, City Staff is hereby <br />directed to recommend the hiring of those experts which <br />will assist the City in property analyzing and studying <br />the issues described herein. <br />Section 6. Exceptions. This moratorium shall not apply to: <br />A. The lawful use of an existing subdivision. <br />B. Construction, location or development of subdivisions <br />which have received all necessary permits and approvals, <br />or have received preliminary plat approval from the City <br />prior to the date of the approval of this Ordinance. <br />C. The creation of cemetery lots. <br />D. Subdivisions resulting from court orders, or the <br />adjustment of a lot line by the movement of a common <br />boundary. <br />Rev. 08/17/99 6 <br />
