RESOLUTION 2015-29 <br />APRPOVING A PUD AMENDMENT AND PRELIMINARY PLAT FOR ELMCREST <br />INVESTMENTS, LLC, FOR "FABLE HILL 4TH" ON PROPERTY <br />LOCATED EAST OF ELMCREST AVE NORTH OF FABLE HILL PARKWAY <br />WHEREAS, Elmerest Investments, LLC, has requested approval of a PUD Amendment and <br />preliminary plat to allow a subdivision for 60 lots and on the 32.3 acre property legally described <br />as follows: <br />Outlet A, Fable Hills Yd Addition <br />WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public <br />Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the request by Elmerest <br />Investments, LLC, for a PUD amendment and preliminary plat, subject to the following <br />conditions: <br />1. A preliminary plat is approved to allow the creation of 46 villa units and 14 single family <br />homes, in accordance with the plans and application received by the City on February 11, <br />2015, and revisions received May 1, 2015, except as amended by this resolution. <br />2. The development shall comply with the Fable Hill PUD standards in Resolution 2002-40, as <br />amended. <br />3. The applicant shall comply with all conditions in the City Engineer's letter dated May 6, <br />2015. <br />4. The applicant shall provide staff with the homeowner association documents for review and <br />approval. The documents shall include language to ensure architectural review and <br />development sign maintenance. <br />5. The setbacks for the development shall be as follows: <br />Setback <br />Proposed <br />House Setbacks: <br />Front yard <br />15 feet <br />Side yard — facing street <br />15 feet <br />Side yard — interior <br />5 feet <br />Rear yard <br />25 feet <br />Garage Setbacks: <br />Front yard — garage door side <br />25 feet <br />Front yard — non -door side <br />15 feet <br />
