RESOLUTION 2015-37 <br />APPROVING VARIANCE TO PLACE ACCESSORY BUILDING IN FRONT OF PRINCIPLE <br />STURCTURE ON PROPERTY LOCATED IN THE RURAL RESIDENTILA ZONING <br />DISTRICT AT 12686 INGERSOLL AVENUE NORTH <br />WHEREAS, John Rawson has requested a variance to allow an accessory building to be placed in the <br />front of the house, where the ordinance states that accessory buildings shall not protrude in front of the <br />principal building on the property legally described as: <br />(See attached) <br />WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed the variance at a duly called <br />public hearing on Thursday, July 23, 2015, and recommended approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />HUGO, MINNESOTA, that it should and hereby does approve an accessory building to be placed in the <br />fi-ont of the house, where the ordinance states that accessory buildings shall not protrude in front of the <br />principal building, with the following conditions: <br />The requested variance is from the accessory buildings requirements of the ordinance and is <br />permissible by law. <br />2- Because of circumstances unique to the property there are practical difficulties on meeting the <br />ordinance. <br />3. The granting of the variance would be in keeping with the spirit and intent of the ordinance. <br />4. The applicant is proposing to use the property in a reasonable manner and construction of an <br />accessory structure is allowed in the rural residential zoning district, <br />5. The proposed variance would not noticeably alter the character to the average person. <br />Accessory structures are a permitted use in the RR District. <br />The subject proposed accessory structure is not within a floodplain. <br />8. The subject property is served by individual well and septic systems. <br />9.
