The applicant shall pay for and construct the public sidewalk that connects Rosemary <br />Way to the private drive and the sidewalk on the north side of the private street. The <br />maintenance of this sidewalk is the responsibility of the association or shall be detailed in <br />the maintenance agreement between the three property owners. <br />in. The private sidewalk shall be constructed with this phase. Construction details shall be <br />submitted for city review and approval. <br />Streets, Access and Parking <br />n. No parking is permitted on the Private Road. <br />o. Cross access and maintenance agreements to include this property shall be recorded with <br />the final plat for the shared private street. <br />,Landscaping and Open Space <br />p. Landscaped areas shall be irrigated. The developer shall submit an irrigation plan for <br />review and approval by the City. <br />q. The applicant shall be responsible for maintenance of the landscaping and irrigation <br />systems on the property. <br />Miscellaneous <br />r. The applicant shall comply with all conditions from the City Engineer's memo dated July <br />16, 2015. <br />s. A complete set of revised plans addressing the conditions of approval shall be submitted <br />for city approval. <br />Outstanding Victor Gardens North Village 3'd Addition Issues <br />t. The applicant must provide proof that the final plat and all associated documents have <br />been filed at Washington County. <br />u. The following documents must be submitted reviewed and approved by the City <br />Attorney. Upon City approval, the applicant shall file these documents at Washington <br />County: <br />1) Articles of Incorporation of Victor Gardens Third Association <br />2) Declaration of Covenants, Conditions and Restrictions of Victor Gardens Third <br />Association <br />3) Private Road, Easement And Maintenance Declaration <br />1. An alternative form of a maintenance agreement will be considered <br />by City staff. Review and approval by City staff is required prior to <br />the recording of the document. Items 1-3 above would be satisfied <br />in this case. <br />
