RESOLUTION 2015-41 <br />APPROVING A FINAL PLAT AND DEVELOPMENT AGREEMENT FOR D.R. <br />HORTON, INC. — MINNESOTA FOR CLEARWATER COVE <br />WHEREAS, D.R. Horton, Inc. — Minnesota, has requested approval of a final plat for the <br />property legally described as follows: <br />(See Attached) <br />WHEREAS, the Planning Commission has reviewed the preliminary plat and PUD at a duly <br />called public hearing and recommended approval of the preliminary plat and PUD; and <br />WHEREAS, the City Council approved the preliminary plat and PUD at its meeting on August <br />3, 2015. <br />NOW, THEREFORE, BE IT HEREBY RESOVLED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the request by D.R. Horton, <br />Inc. — Minnesota, for a final plat, subject to the following conditions: <br />I. The final plat is approved to allow the creation of 28 single family lots and 8 outlots, in <br />accordance with the plans and application received by the City on July 7, 2015, July 17, <br />2015 and August 12, 2015, except as amended by this resolution. <br />2. The development shall substantially comply with all plans and conditions of the PUD and <br />preliminary plat approval granted by the City on August 3, 2015, <br />3. Development standards shall comply with Resolution 2015-38 and 2015-39, as amended. <br />4. The developer shall comply with all conditions outlined in the City Engineer's memo <br />dated July 16, 2015, and August 12, 2015, and revisions required in "redlined" comments <br />from the City Engineer. <br />Outlot use and ownership: <br />a) Outlot A is unplanned but, proposed for future development and will retain the <br />current ownership (LaValle). The outlet is unbuildable until a plan and new plat have <br />been approved by the City. <br />b) Outlot B is proposed for stormwater ponding and a trail, and shall be deeded to the <br />City at the time the plat is recorded. <br />c) Outlot C is unplanned but, proposed for future development and will retain the <br />current ownership (LaValle). The outlot is unbuildable until a plan and new plat have <br />been approved by the City. <br />
