RESOLUTION 2015-45 <br />APPROVING A CONDITIONAL USE PERMIT AMENDMENT FOR RICK MARK <br />TO ALLOW RECYCLING CENTER US ON THE PROPERTY <br />LOCATED AT 15717 FOREST BOULEVARD NORTH <br />WHEREAS, Rick Mark, requested approval of a conditional use permit amendment to <br />allow a recycling center use on the property located at 15717 Forest Boulevard North <br />(See attached Exhibit A) <br />WHEREAS, the Planning Commission has reviewed said conditional use permit at a duly <br />called public bearing on August 27, 2015 and recommends approval subject to the <br />conditions listed in the conditional use permit. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />conditional use permit amendment for Rick Mark to allow a recycling center use on the <br />property located at 15587 Forest Boulevard North with the following findings: <br />1. The applicant shall meet all conditions listed in the revised conditional use <br />permit. <br />2. The request meets the spirit and intent of the ordinance which is to allow a <br />way for recycling centers to be located in the General Commercial (C-2) <br />zoning district by reducing the impact of the use on the surrounding <br />properties. <br />3. The impacts of the recycling center use to the surrounding properties will <br />continue to be reduced by limiting the storage area to the locations on the <br />approved site plan and containing the recyclable material in a way to <br />mitigate the visual and noise impacts. <br />4. A building permit shall be applied for and approved by the Building <br />Department prior to any expansion of the building or new buildings. <br />ADOPTED by the City Council this 8th day of September, 5, 2015 <br /> <br />Tom Weidt, Mayor <br />ATTEST: <br />Michele Lindau, City Clerk <br />
