City Council meeting of August 5, 1991 <br />Page 8 <br />OMNI POOL (BUILDING INSPECTION <br />As per Council direction, the City Building Inspector, State Fire Marshal, <br />City Fire Marshal, County Health Department, and the State Electrical <br />Inspector have conducted inspections of the Omni Pool building at 5118 <br />130th Street, Hugo, MN. Copies of these reports were submitted to the <br />Council for their review. In light of the number of violations cited, <br />Council direction on the City's next course of action would be <br />appropriate. Because of a time factor, this matter will be addressed at <br />the Council meeting of August 19, 1991. <br />EXECUTIVE SESSION <br />McAllister made motion, Brunotte seconded, that the City Council qo into <br />executive session to discuss pending litiqation (David Schumann). <br />VOTING; AYE: Brunotte, Jesinski, Stolt man <br />VOTING NAY: McAllister, Miron <br />Motion Carried. <br />After a brief recess to clear the Council chambers, the Council met in <br />executive session. <br />PRESENT: Brunotte, Jesinsk.i, McAllister, Miron, Stolt man, Administrator <br />Huber, City Attorney Charles Johnson, Attorney Barbara Hatch, and City <br />Clerlf Mary Ann Creager <br />City Attorney Johnson reviewed the City Prosecutor's letter, the Attorney <br />General's opinion, and the Consent Agreement and their relationship with <br />the David Schumann litigation. Strategies were discussed, and the Council <br />agreed to hire a replacement attorney for Richard Hocking to handle the <br />civil prosecution of David Schumann. Barbara Hatch explained the <br />insurance company's position regarding this litigation. <br />Stolt man made motion, Miron seconded, to adjourn the executive session at <br />11:48 PM, and reconvene the regular meeting of the City Council. <br />All ave. Motion Carried. <br />McAllister made motion, Stolt man seconded, directing City Attorney <br />Johnson to provide the names of three attorneys for consideration to <br />represent the City of Hugo in the civil litigation versus David Schumann. <br />The City Council does not feel that Mr. Richard Hock:inq has a conflict c --,-f <br />interest, but it is in the best interest of the City to have another <br />attorney handle this case. <br />All ave.
