MINUTES OF THE PROCEEDINGS <br />OF THE <br />HUGO CITY COUNCIL <br />SPECIAL MEETING <br />June 28, 1986 <br />The meeting was called to order by Mayor McAllister at 8:13AM. <br />PRESENT: Schwab, Potts, Peltier, Hauer, McAllister, Charles Johnson, <br />Jack Hennen <br />Also: Jim Smith, Mr. & Mrs. Ray Olson, Bob Oswald, Howard Schletty <br />McAllister moves, seconded by Potts that six lights be replaced. All aye. <br />Motion carried. <br />It was the concensus of the City Council that Mr. Potts and Mrs. Peltier and <br />a memeber of the legal staff get together and research the information from <br />the legal opinion from the Supreme Court and any other information that is <br />needed for the committee to prepare the reasons the City Council denied the <br />amended Special Use Permit. <br />Potts made motion, seconded by Hauer not to file a request for a rehearing <br />to the Supreme Court. All aye, motion carried. <br />Rice Creek approved the City permit for Oneka Lake project. <br />Motion made by Hauer, seconded by Schwab that Mayor McAllister may direct <br />the City Attorney to dismiss the Zaluckyj condemnation proceeding involving <br />the Oneka Lake level control and surface water drainage system in the event <br />a Department of Natural Resources permit to the City of Hugo is not issued <br />to the City of Hugo prior to final district court hearing date. <br />All aye, motion carried. <br />Potts made motion, seconded by Schwab to adjourn at 10:24AM. <br />All aye, motion carried. <br />Received from Charles Johnson, copy of three briefs, No. C3-85 - 895; <br />C3 - 85-805; and C3-85-805 Relator's brief and Appendix, and respondent's <br />brief and appendix. <br />Theodora Peltier, City Council <br />Acting Secretary <br />TP/cl <br />
