4'7 <br />MINUTES OF THE PROCEEDINGS OF THE HUGO CITY COUNCIL <br />May 22, 1985 <br />The additional regular meeting was called to order at 6:10 PM. <br />PRESENT: Hauer, Peltier, Potts, Schwab, McAllister <br />City Engineer, Howard Kuusisto <br />WILSON TOOL <br />The Council reviewed the License Agreement that will enable Wilson Tool to proceed <br />with the construction of a sanitary sewer service line to their proposed 40,000 square <br />foot addition. Clause 9 refers to the recovery of costs should another property <br />owner want to connect to the line in later years, as Wilson Tool will be paying <br />the entire cost of the project. It was determined that an ordinance change will <br />be required in order to be able to collect these costs. <br />MOTION: Schwab made motion, Peltier seconded, to approve and accept the license <br />agreement between Wilson Tool and the City of Hugo, and authorize the <br />Mayor and City Clerk to sign the agreement. <br />All aye. Motion Carried. <br />ONEKA LAKE WATER PROBLEM <br />Councilman Potts submitted an additional proposal to try and resolve this matter at <br />the Council meeting of 5/20/85. After review, it was determined by Engineer Kuusisto <br />that the additional ditching on the east side of Oneka Lake Boulevard would be <br />$3,000.00, or a total project cost of approximately $11,000.00 <br />For the record, it was the concensus of the Council that the City go through <br />the Alex Zaluckyj property to lower the lake level. The city will prepare an <br />agreement between Mr. Zaluckyj and city. The agreement will be submitted to <br />Mr. Zaluckyj in advance of a special meeting to discuss the proposal. Mr. Zaluckyj <br />will have the opportunity to accept or reject the proposal at a public meeting. <br />If the proposal is not accepted, the City Council will, at that meeting, be prepared <br />to initiate condemnation proceedings. <br />The project could be funded by two possible sources of revenue: issuance of bonds <br />or borrow money from the general fund and repay after a payment schedule, with in- <br />terest, is prepared by the City Council. <br />The Council agreed that some form of action be taken on the Oneka Lake matter this <br />summer. (MRS. PELTIER LEFT THE MEETING AT 7:07 PM). The Council felt it was crucial <br />that people be aware that the sole purpose of the project was to lower Oneka Lake <br />to its ordinary -high -water -mark as set by the DNR. There will be no guarantees that <br />the project will alleviate any residential or agricultural water problems. <br />Mayor McAllister stated that if City Attorney Johnson is unable to prepare the agree- <br />ment because of time restraints, he has the authority to hire temporary, outside, <br />legal counsel. <br />MOTION: Potts made motion, Hauer seconded, that the Mayor and Clerk be authorized <br />to formulate an agreement and letter to Alex Zaluckyj stating the proposals <br />discussed at this meeting. <br />All aye. Motion Carried. <br />
