94 <br /> MINUTES OF THE SPECIAL MEETING OF THE HUGO CITY COUNCIL <br /> November 2, 1983 <br /> The meeting was called to order by Mayor McAllister at 7:45 PM. <br /> PRESENT: Atkinson, Peltier, Schwab, McAllister <br /> ABSENT: Vail (notation made by Lu Prachar, Deputy Clerk/Treasurer, that Vail had <br /> been notified of meeting earlier in the day.) <br /> PURPOSE OF MEETING: Consider the application of John J. Oman for an Amended Special <br /> Use Permit to expand the Twin Pine Trailer Park, and any other city business. <br /> Mayor McAllister stated requirement under Chapter 20 for posting and publication of <br /> special meeting for application of Amended Special Use Permit have been met. Differ- <br /> ences of legal opinion on matter required the presence of a representative from the <br /> Fire Marshall's office, Mr. Ron Sockness. Differences in opinion stem from the fact <br /> that the Uniform Fire Code requires installation of fire hydrants in the trailer park, <br /> and the NFPA does not. Also, the City of Hugo has not adopted the Uniform Fire Code. <br /> Question is - which authority does the City follow? <br /> Letters were presented to the City by Ms. Karla Wahl, Mr. Oman's attorney, concerning <br /> the tornado and storm shelter and noise abatement. Mayor McAllister read both letters, <br /> and are on file with the City Clerk. <br /> Fire Chief, Ron Istvanovich, presented a diagram of the park showing where hydrants <br /> should be located. Mr. Sockness reviewed the diagram, verbally, with the Council <br /> and audience present. <br /> Mr. Johnson, Hugo City Attorney, stated his opinion and problem with the fact of <br /> which authority takes precedence - the UFC or NFPA. His understanding was that Mr. <br /> Oman flatly refused to place hydrants in park because of the cost factor. Mr. Johnson's <br /> final recommendation was that since we have a definite problem as to the applicability <br /> of the code, the City should request the Minnesota Attorney General for a ruling on the <br /> situation. He recommended that the City not act on issuance of the ASUP until this <br /> ruling has been handed down. The alternate proposals made verbally as part of this <br /> application, with regard to park changes, street widening, etc. , should be documented <br /> and submitted to the Fire Chief and Council, before action on the matter is resolved. <br /> MOTION: McAllister made motion, Schwab seconded, directing the City Attorney to seek <br /> a legal opinion from the Minnesota Attorney General's office, or research <br /> ruling on similar matter, and Council will hold a special meeting, and give <br /> proper notice when received. <br /> All aye. Motion Carried. <br /> MOTION: McAllister made motion, Peltier seconded, to allow the Sunset Lake Homeowner's <br /> Association to hold a meeting with the City Engineer on the fourth Monday <br /> in January, 1984, at Hugo City Hall, to informally discuss the possibility <br /> of blacktopping Ingersoll and Homestead Drive, and such meeting not to be <br /> considered a City Council meeting. <br /> All aye.
