JULY 21t 1975 ,° 1 VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED 5.1 POLICE CHIEF VACATION The City Council approved the Police Chief requested vacation of October 17, through October 28, 1975. Patrolman Jackson will work his schedule and will be on call of which the Washington County Sheriff Office was notified. 5.2 TENNIS COURT - ZINSCHLAG MOTION: Lease made motion, Leroux seconded to grant aVafiance to build a Tennis Court on Lots 24 and 25 of Sunset Park, a Variance allowing the building of a Tennis Court with no other principle building. A second granting of a Variance allowing the front and side of these two lots, the side variance between 24 and 25 zero feet; side lot of 25 south end, be 151 ; through Easterly front part of lots 25 and 24 10' variance to not less than 10' as a Permitted Assessory Use under RR2. VOTING FOR: Lease, LaValle, Leroux, Smith. VOTING AGAINST: Schletty MOTION CARRIED MOTION: Lease made motion, Smith seconded to grant a Special Use Permit to Gordon Zinschlag to install a front yard fence on lots 24 and 25 to fence in his tennis court, a fence to exceed the 4' maximum height,as per Chapter 98 Subd. D. and not over 101 . VOTING FOR: Lease, LaValle, Leroux, Smith. ABSTAIN: Schletty MOTION CARRIED 5.3 SHIMOTA RE: PI.G FEED LOT COMPLAINT Property owners live at 9824 - 140th. St. No. , pig farm at 9686 - 140th. St. No. , Hugo. Shimotas claim their life style has changed considerable due to the stench of the pigs and manure. They no longer entertain inside or outside of their home, they no longer enjoy their gardening due to the smell. They further claim that the Moes, pig feed lot owners, have not lived up to their conditions when applying for their permit to the Minnesota Pollution Control Agency namely; 1 . Cementing should be removed and spread. Council informed the Shimotas that the feed lot was grandfathered in. The City of Hugo nor the PCA has any control over animal odors in an Agricultural zone.
