AFFIDAVIT OF PUBLICATION <br />CITY OF • <br />CITY OF HUGO <br />WASHINGTON COUNTY, MINNESOTA <br />ORDINANCE 1998-326 <br />AN ORDINANCE OF THE CITY OF <br />HUGO, WASHINGTON COUNTY, MIN- <br />NESOTA, REPEALING THE EXISTING <br />CHAPTER 264 OF THE CITY CODE AND <br />REPLACING IT WITH A NEW CHAPTER <br />264 REGULATING THE SHOOTING OF <br />FIREARMS WITHIN THE CITY OF <br />HUGO. <br />The City Council of the City of Hugo, <br />Washington County, Minnesota, does here- <br />by ordain as follows: <br />264.01 Repeal. <br />The existing Chapter 264 of City <br />Ordinances entitled "Shooting <br />Regulations" is hereby repealed in its <br />entirety and replaced by this Ordinance. <br />264.02 Purpose. <br />It is the purpose of the City Council in <br />passing this Ordinance to provide that the <br />shooting of firearms within the City limits <br />will not constitute an unreasonable nui- <br />sance to persons in Hugo. This Ordinance <br />is designed to prevent nuisances caused by <br />the noise created from the discharge of <br />firearms, and to minimize the potential that <br />projectiles discharged from firearms could <br />injure individuals. The City Council deems <br />these regulations necessary to protect pub- <br />lic and private property and to promote <br />, safety, order, convenience, and the <br />tl welfare of persons within the City <br />go. <br />264.03 Shooting Regulated. <br />No person shall fire or discharge guns or <br />firearms of any kind within the limits of <br />any City road, County road, public park, or <br />other City property, or on any occupied pri- <br />vate property (except with the consent of <br />the owner or legal occupant thereof), pro- <br />vided, however, that this Chapter shall not <br />apply to the lawful defense of persons or <br />property, or in the necessary enforcement <br />of the laws, or for trap shooting on premis- <br />es owned or controlled by any duly incor- <br />porated social organization, or when <br />ordered by the military authority. <br />264.04 Hunting With Firearms in Certain <br />Areas. <br />A. A person may not take a wild animal <br />with a firearm within five hundred (500) <br />feet of a building occupied by a human or <br />livestock anywhere within the City. <br />B.
