AFFIDAVIT OF PUBLICATION CITY OF • CITY OF HUGO WASHINGTON COUNTY, MINNESOTA ORDINANCE 1998-326 AN ORDINANCE OF THE CITY OF HUGO, WASHINGTON COUNTY, MIN- NESOTA, REPEALING THE EXISTING CHAPTER 264 OF THE CITY CODE AND REPLACING IT WITH A NEW CHAPTER 264 REGULATING THE SHOOTING OF FIREARMS WITHIN THE CITY OF HUGO. The City Council of the City of Hugo, Washington County, Minnesota, does here- by ordain as follows: 264.01 Repeal. The existing Chapter 264 of City Ordinances entitled "Shooting Regulations" is hereby repealed in its entirety and replaced by this Ordinance. 264.02 Purpose. It is the purpose of the City Council in passing this Ordinance to provide that the shooting of firearms within the City limits will not constitute an unreasonable nui- sance to persons in Hugo. This Ordinance is designed to prevent nuisances caused by the noise created from the discharge of firearms, and to minimize the potential that projectiles discharged from firearms could injure individuals. The City Council deems these regulations necessary to protect pub- lic and private property and to promote , safety, order, convenience, and the tl welfare of persons within the City go. 264.03 Shooting Regulated. No person shall fire or discharge guns or firearms of any kind within the limits of any City road, County road, public park, or other City property, or on any occupied pri- vate property (except with the consent of the owner or legal occupant thereof), pro- vided, however, that this Chapter shall not apply to the lawful defense of persons or property, or in the necessary enforcement of the laws, or for trap shooting on premis- es owned or controlled by any duly incor- porated social organization, or when ordered by the military authority. 264.04 Hunting With Firearms in Certain Areas. A. A person may not take a wild animal with a firearm within five hundred (500) feet of a building occupied by a human or livestock anywhere within the City. B. A person may not take a wild animal with a firearm without the permission of the owner, occupant, or lessee, within five hundred (500) feet of a stockade or corral containing livestock anywhere within the City. 264.05 Penalty. Any person violating the provisions of this Chapter shall be guilty of a misde- meanor. 264.06 Effective Date. This Ordinance shall be in full force and :)m and after its passage and publi- .cording to law.
