14 <br />CITY OF HUGO <br />WASHINGTON COUNTY, MINNESOTA <br />ORDINANCE NO. 1998- 327 <br />AN ORDINANCE ESTABLISHING A STORM SEWER IMPROVEMENT TAX DISTRICT <br />WITHIN THE MEANING OF MINNESOTA STATUTE §444.16 ET. SEQ. <br />The City Council for the City of Hugo, Washington County, <br />Minnesota, hereby ordains as follows: <br />Section 1. Purpose. <br />This Ordinance is adopted to establish a storm sewer <br />improvement tax district within the meaning of Minnesota Statute <br />§444.16 et. sec. The district is established in order to create a <br />framework to maintain the storm sewer drainage system within the <br />plat of Creek View Preserve. <br />The City Council has determined that it is in the best <br />interests of the City to set up a method to insure that the <br />drainage areas and outlots are properly maintained for the benefit <br />of the residents of the plat, and that the costs of maintenance are <br />fairly and equitably apportioned among those properties <br />contributing water to those drainage areas. <br />Section 2. Authority. <br />The City has adopted this Ordinance pursuant to the provisions <br />of Minnesota Statute §444.16 et. sec.. <br />Section 3. Description of Land. <br />Pursuant to Minnesota Statute §444.17, the territory or area <br />included within the storm sewer improvement district is described <br />with particularity on the attached Exhibit A, said land is <br />hereinafter referred to herein as the "Subwatershed." <br />Section 4. Name of District. <br />The storm sewer improvement district created herein shall <br />hereinafter be referred to as "Hugo Storm Sewer Improvement Tax <br />District No. 2." <br />Section 5. Filings. <br />The City Clerk of the City of Hugo is hereby directed to file <br />a certified copy of this Ordinance with the County Auditor and a <br />separate certified copy with the County Recorder pursuant to the <br />statutory mandate found in Minnesota Statute §444.17. <br />
