UBC Appendix Chapter 31 -Division II- <br /> Membrane Structures <br /> 40-1.4 Application, Administration, and <br /> Enforcement. The application, administration, <br /> and enforcement of the Minnesota State <br /> Building Code in the City shall be in accordance <br /> with Minnesota Statutes Chapter 16B and <br /> Minnesota Rules Chapters 1300 and 1305.The <br /> City Council, pursuant to Minnesota Statutes <br /> 168.65, shall appoint a Building Official who <br /> shall attend to all aspects of Building Code <br /> administration. Additional members of a City <br /> Building Department shall be authorized by the <br /> City Council as needed. Organization of the <br /> City's Building Department shall be as estab- <br /> lished by Chapter 1 of the 1994 Uniform <br /> Building Code, as amended by Minnesota <br /> Rules.The Minnesota State Building Code shall <br /> be enforced within the incorporated limits of the <br /> City. <br /> 40-2 Certificate of Occupancy. The City <br /> hereby adopts Chapter 1305.0109, Section <br /> 109, "Certificate of Occupancy," of the <br /> Minnesota State Building Code requiring <br /> Certificates of Occupancy for Group R,Division <br /> III occupancies; Group U occupancies; and <br /> manufactured homes. <br /> 40-3 Permits, Inspections and Fees. <br /> Permits shall be issued, <br /> inspections conducted, and fees collected <br /> according to the following: <br /> 1.Fees. <br /> A. Fees and charges shall be due and <br /> payable upon initial application for permit, and <br /> shall be collected from the applicant for said <br /> permit. <br /> B.The valuation for permit purposes shall <br /> be determined by the Administrative Authority, <br /> and shall calculated by multiplying the square <br /> foot area of the proposed structure times the <br /> factor prescribed by the State of Minnesota, <br /> Building Code Division, as is in effect at the <br /> time of application. <br /> C. Where work for which a permit is <br /> required is started or proceeded with prior to <br /> obtaining said permit, the permit fee shall be <br /> double, but the payment of such double fee <br /> shall not relieve any persons from fully comply- <br /> ing with existing codes or ordinances in the <br /> execution of the work nor from any other applic- <br /> able penalties. <br /> D.The fees and charges listed herein are <br /> exclusive of fees and charges required by the <br /> State of Minnesota pertaining to electrical per- <br /> mits and inspections. <br /> E. At the discretion of the Administrative <br /> Authority, an additional charge, no to exceed <br /> actual expenses incurred, may be required in <br /> such instances where repeated violations of the <br /> building codes and ordinances make necessary <br /> an excessive number of reinspections in order <br /> to insure compliance with the provisions of said <br /> codes and ordinances. Such charges shall be <br /> payable by the permittee prior to the issuance <br /> of Certificate of Occupancy. <br /> F.All building permit and related fees shall <br /> be established by Council resolution. <br /> 2.Surcharge. <br /> In addition to the permit fee required under <br /> Section 3 above, the applicant for a Building <br /> Permit shall pay a surcharge to be remitted to <br /> the Minnesota Department of Administration as <br /> prescribed by Minnesota Statutes 168.70. <br /> This Ordinance shall be in full force and <br /> effect from and after its passage and publica- <br /> tion according to law. <br /> WHEREUPON, said Ordinance was <br /> declared passed and adopted this 21st day of <br /> August,1995. <br /> iron,Mayor <br /> Attest: <br /> Mary Ann Creager,City Clerk <br /> Published in the White Bear Press August <br /> 30,1995. <br />
