. , <br />� . <br /> � <br /> ORDINANCE 1995- .�0 �� <br /> .° <br /> AN ORDINANCE REGULATING THE DEVELOPMENT OF SHORELANDS <br /> AND REPEALING INCONSISTENT ORDINANCES <br /> The City of Hugo ordains: <br /> Section 1 . INCONSISTENT ORDINANCE REPEALED. Chapter 320, ARTICLE III , <br /> Sections 320-40 through 320-50 are hereby repealed in their entirety and <br /> replaced with the provisions of this ordinance. <br /> Section 2. REGULATIONS ADOPTED. Chapter 320 of the Hugo City Code is <br /> hereby amended by adding Sections 320-40 through 320-62, as stated herein . <br /> 320-40 PURPOSE AND INTENT. In that the uncontrolled use of shorelands <br /> degrades water quality , diminishes the recreational and economic <br /> use of the city ' s lakes and streams, fosters erosion and related <br /> surface water drainage problems, and reduces desired fish and <br /> wildlife habitat, it is in the best interests of the public' s <br /> health, safety and welfare to regulate development and <br /> redevelopment of the city ' s shoreland areas to promote and protect <br /> their natural , social , and economic value. <br /> 320-41 STATUTORY AUTHORITY. This ordinance is adopted pursuant to <br /> Minnesota Statutes, Chapters 105, Water Conservation ; 462, <br /> Planning and Zoning , 412, Statutory City Power; as well as <br /> Minnesota Regulations, Parts 6120.2500-6120.3900. <br /> 320-42 REPEAL OF INCONSISTENT ORDINANCE. Sections 320-40 to 320-50 of <br /> the Hugo City Code are hereby repealed in their entirety , and <br /> replaced with Sections 320-40 to 320-63, as herein defined . <br /> 320-43 JURISDICTION. The provisions of this ordinance shall apply to the <br /> shorelands of the public water bodies as classified in Section <br /> 320-47 of this ordinance. <br /> 320-44 DEFINITIONS. Unless specifically defined below, words or phrases <br /> used in this ordinance shall be interpreted so as to give them the <br /> same meaning as they have in common usage, and to give this <br /> ordinance its most reasonable application . <br /> 1 . Accessory r facility . "Accessory Structure" or <br /> "Accessory Facility" means any building or improvement <br /> subordinate to a principal use. <br /> 2 . Bluff . "Bluff" means a topographic feature such a hill , <br /> cliff , or embankment having the following characteristics: <br /> (a) Part or all of the feature is located in a shoreland <br /> ( b) The slope rises at least 25 feet above the ordinary high <br /> water level of the water body ; <br /> ( c) The grade of the slope from the toe of the bluff to a <br /> point 25 feet or more above the ordinary high water <br /> level averages 30 percent or greater; and <br /> 1 <br />
