• ORDINANCE 92-275 <br /> AN ORDINANCE AMENDING CABLE COMMUNICATIONS FRANCHISE <br /> ORDINANCE 89-257 AMENDING PROVISIONS TO LOCAL PROGRAMMING <br /> The City Council of the City of Hugo ordains: <br /> Section 1. Article III , Section 5(E) of the Cable Communications <br /> Franchise Ordinance is amended as follows: <br /> E. Grantee shall provide to City within ninety (90) days of a written <br /> request the equipment stated in the Offering, or the substantial <br /> equivalent of the equipment, as directed by City, consisting of one <br /> ( 1) camcorder, monitor, tripod, and recorder, at a cost of Three <br /> Thousand and No/100 Dollars ($3,000) , as well as the modulator and <br /> character generator stated in the Offering. Pursuant to law, Grantee <br /> shall also make available for public use at least the minimal <br /> equipment necessary for the production of programming and playback of <br /> prerecorded programs for the specially designated noncommercial access <br /> channels. Grantee shall also make readily available, upon need being <br /> shown, the minimum equipment necessary to make it possible to record <br /> programs at remote locations with battery operated portable <br /> equipment. Nothing in this Franchise shall be construed as requiring <br /> the duplicate of said equipment. <br /> ( 1) Need within the meaning of this paragraph shall be determined by <br /> Subscriber petition. Said petitions must contain the signatures of at <br /> least ten percent ( 10%) of the Subscribers of System, but in no case <br /> more than five hundred (500) nor fewer than one hundred ( 100) <br /> signatures. <br /> (2) The Offering of the Grantee dated February 21, 1989, shall be <br /> considered amended consistent with the Ordinance and the letter from <br /> Grantee dated March 11, 1992. <br /> (3) This Ordinance shall be effective following enactment by the City, <br /> acceptance by the Grantee, and publication in the City's legal <br /> newspaper. <br /> Upon roll call, voting AYE: Barnes, Brunotte, Lerous, Miron <br /> Voting NAY: None <br /> Whereupon said Ordinance was declared passed and adopted this 8th day of <br /> September, 1992. <br /> a)ziau V. <br /> Walter L.
