( 2 ) For failure to provide data, documents , reports or <br /> information or to cooperate with City during an <br /> application process or System review, the penalty shall <br /> be One Hundred Dollars ( $100 . 00 ) per day for each day, <br /> or part thereof, such failure occurs or continues . <br /> ( 3) For failure to comply with any of the provisions of this <br /> Franchise for which a penalty is not otherwise <br /> specifically provided pursuant to this paragraph C, the <br /> penalty shall be One Hundred Dollars ( $100 . 00) per day <br /> for each day, or part thereof , such failures occurs or <br /> continues . <br /> ( 4 ) For failure to test, analyze and report on the <br /> performance of the System following a request by City, <br /> the penalty shall be One Hundred Dollars ( $100 . 00) per <br /> day for each day, or part thereof, such failure occurs <br /> or continues . <br /> (5 ) For failure by Grantee to modify the System or to <br /> provide additional services within one hundred eighty <br /> ( 180) days after such modification is required by this <br /> Franchise under Article VI , Section 4 , paragraph C(4 ) , <br /> the penalty shall be Five Hundred Dollars ( $500 . 00) per <br /> day for each day, or part thereof, such failure occurs <br /> or continues . <br /> ( 6 ) Forty-five (45 ) days following notice from City of a <br /> failure of Grantee to comply with construction, <br /> operation or maintenance standards, the penalty shall be <br /> Five Hundred Dollars ( $500 . 00 ) per day for each day, or <br /> part thereof, such failure occurs or continues . <br /> 45 <br />
