upon such use of water and/or waste water flow. The City Council <br />may by resolution, require and order the installation of such meter <br />on any such lot, parcel, premises or unit or class thereof, where <br />it shall determine that the aforementioned flat rate for sewerage <br />usage is impractical to apply, or results in inequitable charges <br />because insufficient or excessive; thereafter, the rate shall be <br />based upon such metering. The cost of metering shall be paid by <br />the owner of the property being metered. <br />300-19. INFORMATION. The owner, occupant, or person in <br />charge of any premises shall supply to the City such information <br />as the City may reasonably require related to use of water, use of <br />sewer, or sewer rates. Willful failure to provide such information <br />or willful falsification of such information shall constitute a <br />violation of this Chapter, as shall willful failure to comply with <br />any requirement or order issued pursuant to this Chapter. <br />300-20. ESTIMATED BILLS. If the owner, occupant or person <br />in charge of any premises shall fail to provide information as <br />required by this Chapter, or shall fail or refuse to comply with <br />any requirement of this Chapter, the proper charge for such premises <br />shall be estimated and billed in accordance with such estimate. <br />300-21. SEPARABILITY OF SECTIONS. If any portion of this <br />Chapter shall be held invalid, the invalidity of such portion shall <br />not affect the validity of the other provisions of this Chapter <br />which shall continue in full force and effect. <br />300-22. PENALTY PROVISION. Any person, firm or corporation <br />who shall do or commit any act that is forbidden by the provisions <br />of this Chapter shall be guilty of a misdemeanor, and upon conviction <br />thereof, shall be punished by a fine not to exceed Three Hundred <br />Dollars ($300.00) or to be imprisoned in the County Jail for a period <br />not to exceed ninety (90) days, or both, plus the cost of prosecution <br />in either case. <br />300-23. VARIANCES. Where there are practical difficulties <br />or unnecessary hardships in the way of carrying out the strict letter <br />of the provisions of this Chapter, the City Council shall have the <br />power to vary the requirements of this Chapter in harmony with the <br />general purpose and intent thereof, so that the public health, safety, <br />and general welfare may be secured and substantial justice done. <br />300-24. ENTRY UPON PRIVATE.PROPERTY. The City Engineer <br />and other duly authorized employees of the City bearing proper <br />credentials and identification, shall at reasonable times be permitted <br />to enter upon all properties for the purpose of inspection, observa- <br />tion, measurement, sampling and testing in connection with the opera- <br />tion of the municipal sanitary sewer system. <br />
