3 <br /> ORDINANCE 1987-243 <br /> AN ORDINANCE AMENDING CHAPTER 170 OF THE HUGO CITY <br /> CODE ENTITLED "MINING, EXCAVATING, AND GRADING." <br /> The City Council of the City of Hugo, Washington County, Minnesota, <br /> hereby ordains: <br /> 1 . In Chapter 170-2, Subd B, add the following as Item 10: "Mining shall <br /> not include blasting". <br /> 2. In Chapter 170-5, Subd. A, insert the following language after the <br /> last sentence: in accordance with the procedures and requirements of <br /> the Nuisance Ordinance, Chapter 200. <br /> 3. In Chapter 170-6- Subd. A, delete: "A fee of $25.00 shall accompany <br /> each application". , and insert the following: "A fee, as determined <br /> by Council resolution, shall accompany each application". <br /> 4. In Chapter 170-7, Subd. C, delete "30 feet" in line 1 and insert "50 feet". <br /> 5. In Chapter 170-7, Subd. D, delete first paragraph in its entirety and <br /> insert the following: "Inspections will occur twice annually. Such <br /> inspections will be recorded via written documentation listing areas <br /> to be corrected." <br /> 6. In Chapter 170-7, Subd. D, add second paragraph: "The inspection fee <br /> to cover the cost of periodic inspections shall be based on actual costs <br /> incurred or as set by Council resolution. The method of determining <br /> the inspection fee shall follow Schedule A as outlined below:" <br /> 7. In Chapter 170-7, Subd. D, delete Schedule B in its entirety. <br /> 8. In Chapter 170-7, Subd G, delete dollar amounts and insert the following, <br /> respectively: $300,000.00 and $600,000.00. <br /> 9. In Chapter 170-7, Subd. H, delete in its entirety and insert the following: <br /> "Maintain and operate all equipment to meet all applicable Minnesota <br /> Pollution Control Agency's standards." <br /> 10. In Chapter 170-7, Subd. I, change hours of operation from 7:00 AM and <br /> 7:00 PM to 7:00 AM and 6:00 PM. <br /> 11 . In Chapter 170-8, delete in its entirety and insert the following: "Any <br /> firm, person, or corporation who violates any of the provisions of these <br /> regulations shall be guilty of a misdemeanor. Each day that a violation <br /> is permitted to exist shall constitute a separate offense. <br /> EFFECTIVE DATE.
