ORDINANCE 185 <br /> AN ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE <br /> ENTITLED "ZONING" BY AMENDING CERTAIN FEES AND ESTABLISHING <br /> NEW FEES AND A COST RECOVERY PROCEDURE FOR THE CITY. <br /> The City Council of the City of Hugo, Washington County, Minnesota, hereby <br /> ordains: <br /> 1 . In Section 320-10, entitled "Fees", delete all and insert the following: <br /> The minimum fee to be paid for each application shall be as follows: <br /> Site Plan, Farm $10.00 <br /> Site Plan, Residential Zones $15.00 <br /> Site Plan, RB, CB, or I $75.00 <br /> Zoning Amendment Petition $65.00 <br /> Variance Application $15.00 <br /> Special Use Permit $45.00 <br /> Amended Special Use Permit $25.00 <br /> Planned Unit Development $200.00 plus $5.00 per acre <br /> Planned Unit Development Amendment $50.00 <br /> Land Division $25.00 per parcel created <br /> It is the purpose of the City to recover all costs and expenses incurred. <br /> Immediately after an application is filed, the City shall provide an estimate <br /> of the cost of expenses and review. The applicant shall be notified of the <br /> estimate, and shall immediately deposit an additional sum of money being the <br /> difference of the application fee and the estimated cost. If during the course <br /> of review, it is determined by the City that the amount of money deposited <br /> by the applicant is insufficient to cover expenses, the applicant shall be <br /> notified, and an additional deposit of funds will be required. Upon com- <br /> pletion of review, and prior to final action by the City, the final costs <br /> shall be determined and applicant shall be notified of any deficiencies in <br /> the amounts of money deposited. Any such deficiency shall be paid to City <br /> by applicant prior to final action by the City. In the event costs actually <br /> incurred by the City are less than the estimated costs, the City shall refund <br /> to the applicant the difference between the amount of deposit less the base <br /> application fee and the actual expenses. Failure to deposit required expenses <br /> shall be a basis for rejecting the application. For applications that may <br /> result in action requiring periodic inspection or periodic review, the City <br /> may require reimbursement of any such additional expenses, and may require <br /> further deposit of funds to cover such anticipated periodic expenses, and <br /> may require such other or additional security as may be deemed appropriate <br /> to secure the reimbursement of expenses to the City. <br /> EFFECTIVE DATE: This ordinance becomes effective upon its passage and publication <br /> according to law, and upon becoming effective shall be incorporated in the City Code. <br /> ADOPTED AND PASSED THIS 7th DAY OF December , 1981 . <br /> ATTEST: `� V <br /> Marvin LaValle , Mayor <br /> rt <br /> a <br /> Carol A.
