]i ORDINANCE NO. 165 <br /> AN ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE ENTITLED <br /> "ZONING" BY REQUIRING SITE PLAN APPROVAL IN THE RB AND CB DISTRICTS. <br /> The City Council of the City of Hugo hereby ordains: <br /> In Section 320-4, entitled "Use District Provisions and Regulations", <br /> Subd. J, entitled "Regulations for the Retail Business District" (RB) , and <br /> Subd. K, entitled "Regulations for the Concentrated Business District" (CB, <br /> there shall be inserted the following: <br /> (4) No land shall be used and no building shall hereafter be erected or <br /> structurally altered except for one or more of the following uses <br /> allowed under this section, and, only, when the owner has submitted <br /> a Site Plan to the City Council and the City Council has approved the <br /> plan. The plan shall include the proposed use of the facility; shall <br /> include plans for the overall parcel of land; shall comply with the <br /> Ordinances of the City; shall include surface drainage plans; sanitary <br /> sewer service plans; the nature of any waste that will be discharged <br /> in the sanitary sewer; utility plans; parking facilities; and any <br /> traffic plans or any other requirements requested by the City. These <br /> plans shall be in a form that can be reviewed by the City Engineer. <br /> These plans shall be reviewed with regard to these matters and with <br /> respect to the Comprehensive Plan, to the use of surrounding property, <br /> and to the impact of the proposed facility on the total community. <br /> The City Council may refer the plans to the Planning Commission, the <br /> City Engineer or the City Planner for recommendations. <br /> Site Plan approval shall be granted by the City Council provided the <br /> following conditions are satisfied: <br /> A. The owner shall file an application on a form to be determined <br /> by the City requesting approval of the Site Plan. <br /> B. The Site Plan shall be drawn to scale (no less than 1/8" = 1 foot) . <br /> C. The Site Plan shall include a drawing of the lot on which <br /> the building is to be built. <br /> D. The Site Plan and application shall be filed with the Ad- <br /> ministrative Authority, along with the required fee. The <br /> Administrative Authority shall, then, review the Plan and <br /> either: <br /> 1 . Issue the Permit <br /> 2. Recommend changes in the Site Plan <br /> 3. Refer the Plan to the Planning Commission <br /> E. If referred to the Planning Commission, that body may hold a <br /> public hearing. The Planning Commission shall make recommenda- <br /> tions to the City Council within 90 days after referral. <br /> Failure of the Planning Commission to submit a recommendation <br /> within the prescribed time shall be construed as a recommendation <br /> of approval. <br />
