ORDINANCE NO. 1976-4e 1 l5 <br /> AN ORDINANCE FOR THE PURPOSE OF PROMOTING HEALTH, SAFETY, ORDER, <br /> CONVENIENCE AND GENERAL WELFARE , BY REGULATING THE SPECIFICATIONS , <br /> INSTALLATION, AND MAINTENANCE OF ON-SITE SEWER DISPOSAL SYSTEMS IN <br /> THE CITY OF HUGO, MINNESOTA. <br /> ARTICLE II - ON-SITE SEWER SYSTEMS <br /> 262-25. SHORT TITLE. This Ordinance shall be known, <br /> cited and referred to as the On-Site Sanitary Sewer Disposal <br /> Ordinance, except as referred to herein, where it may be known as, <br /> "This Ordinance" , or "This Chapter" . <br /> 262-26. INTENT AND PURPOSE. This Ordinance is adopted <br /> for the purpose of: <br /> (1) Protecting the health, safety and welfare <br /> residents and future residents of the City <br /> of Hugo. <br /> (2) Regulating individual sewer disposal systems <br /> so as to prevent contamination of underground <br /> bodies of water or of streams, lakes, rivers <br /> or other surface bodies of water. <br /> (3) Preventing individual sewer disposal systems <br /> from creating a health hazard and/or a <br /> nuisance for the general public or for <br /> individuals. <br /> (4)- - Making it unnecessary to provide central <br /> public sewage disposal systems for areas of <br /> the City of Hugo not intended for urban <br /> development in the foreseeable future, as <br /> indicated by the Comprehensive Plan for the <br /> City of Hugo. <br /> 262-27. RULES. The following Rules of Construction apply <br /> to this Ordinance. <br /> Subd. A. Conflicting Provisions. In the event of <br /> conflicting provisions in the text of this Ordinance, the <br /> more restrictive provision shall apply. The City Plumbing <br /> Inspector shall rule on what is more "restrictive" and <br /> appeals from said decisions may be made in the manner <br /> provided. <br /> Subd. B. Word Meaning. Words used in the present tense <br /> include the past and future tense; the singular number <br /> includes the plural and the plural includes the singular; <br /> the word "shall" is mandatory, and the word "may" is <br /> permissive. <br /> 262-28. DEFINITIONS. The terms used herein shall be <br /> defined as set forth in the following subdivisions. <br /> -1- <br />
