262-34 . ABATEMENT ACTION BY CITY. In the event <br /> of a violation or a threatened violation of this Ordinance, the <br /> City Council, or any member thereof, in addition to other remedies , <br /> may institute appropriate actions or proceedings to prevent, restrain, <br /> correct, or abate such violations or threatened violations and it <br /> is the duty of the City Attorney to institute such action at the <br /> direction of the City Council. <br /> 262-35. TAXPAYER ACTION. Any taxpayer of the City <br /> may institute mandamus proceedings in District Court to compel <br /> specific performance by the proper official or officials of any <br /> duty required by this Ordinance. <br /> 262-36. SEPARABILITY. It is hereby declared to be the <br /> intention that the several provisions of this Ordinance are <br /> separable in accordance with the following: <br /> Subd. A. Invalid Provision. If any court of competent <br /> jurisdiction shall adjudge any provision of this Ordinance <br /> to be invalid, such judgement shall not affect any other <br /> provisions of this Ordinance not specifically included <br /> in said judgement. <br /> Subd. B. Invalid Application to Property. If any <br /> competent jurisdiction shall adjudge invalid the appli- <br /> cation of any portion of this Ordinance to a particular <br /> property, building, or other structure, such judgement <br /> shall not affect the application of said provision to <br /> any other property, building or structure not specifically <br /> included in said judgement. <br /> Subd. C. Other Ordinances Not Altered. Nothing contained <br /> in this Ordinance repeals or amends any ordinance requiring <br /> a permit or license to engage in any business or occupation. <br /> 262-37. VARIANCES. Where there are practical difficulties <br /> or unnecessary hardships in the way of carrying out the strict letter <br /> of the provisions of this Ordinance, the City Council shall have <br /> the power to vary requirements in harmony with the general purpose <br /> and interest thereof, so that the public health, and safety. and <br /> general welfare may be secured and substantial justice done. <br /> 262-38 . EFFECTIVE DATE.
