shall be based upon such use of water and/or waste water flow. The <br />City Council may by resolution, require and orier the installation <br />of such meter on any such lot, narce4 premises or unit or class <br />thereof, where it shall determine that the aforementioned flat rate <br />for sewerage usage is impractical to apply, or results in inequit- <br />able charges because insufficient or excessive; thereafter, the rate <br />shall be based upon such metering. <br />262-19. INFORMATION. The owner, occupant, or person <br />in charge of any premises shall supply to the City such information <br />as the City may reasonably require related to use of water, use of <br />sewer, or sewer rates. Willful failure to provide such information <br />or willful falsification of such information shall constitute a <br />violation of this Chanter, as shall willful failure to comply with <br />any requirement or order issued pursuant to this Chapter. <br />262-20. ESTIMATED BILLS. If the owner, occupant or per- <br />son in charge of any premises shall fail to provide information as <br />required by this Chanter, or shall .fail or refuse to comply with any <br />requirement of this Chanter, the nroner charge for such premises <br />shall be estimated and billed in accordance with such estimate. <br />262-21. SEPARAnILITY OF SECTIO71S. If any portion of this <br />Chapter shall be hell invalid, the invalidity of such portion shall <br />not affect the validity of the other provisions of this Chapter <br />which shall continue in full force and effect. <br />2G2-22. PENALTY PROVISION. Any person, firm or corpo- <br />ration who shall do or commit any act that is forbidden by the pro- <br />visions of this Chanter shall be guilty of a misdemeanor, and upon <br />conviction thereof, shall be punished by a fine not to exceed Three <br />Hundred Dollars ($300.00) or to be imprisoned in the County Jail for <br />a period not to exceed ninety (90) days, or both, plus the cost of <br />prosecution in either case. <br />262-23. VARIANCES. Where there are practical difficult- <br />ies or unnecessary hardships in the way of carrying out the strict <br />letter of the provisions of this Chanter, the City Council shall <br />have the power to vary the requirements of this Chanter in harmony <br />with the general purpose and intent thereof, so that the Public <br />health, safety, and general welfare may be secured and substantial <br />justice done. <br />262-24. ENTRY UPON PRIVATE PROPERTY. The City Engineer <br />and other duly authorized employees of the City bearing proper <br />credentials and identification, shall, at reasonable times, be per- <br />mitted to enter upon all nronerties for the purpose of inspection, <br />observation, measurement, sampling and testing in connection with <br />the operation of the municipal sanitary sewer system. <br />
