The owners shall have sixty (60) days from the date they are notified tha <br /> they exceed these standards to prepare and submit to the City Council and <br /> Planning Commission detailed plans for abatement of noise so that the <br /> operation will be brought within the required standards. Once the plans <br /> are approved by the City Council, the owners will have six (6) months <br /> to complete construction in accordance with the abatement plans so <br /> approved. <br /> 12. At no time shall there be a change in the physical operation of the club <br /> without notification to the city and at no time shall the current size of <br /> the physical operation of the club be increased. <br /> 13. The 200 yard range to be discontinued at its current location. The 200 <br /> yard range may be reinstated only after approval by the city. <br /> 14. Should the City Council determine that any of the conditions of the Speci: <br /> Use Permit have been violated and that said violation has not been <br /> corrected within thirty (30) days of notification of the property owner <br /> of said violation, the City Council shall schedule a public hearing, with <br /> notice to the owners, to consider the violation or violations, and <br /> thereafter may suspend, modify, or revoke the Special Use Permit, <br /> giving reason for the action taken. <br /> 15. The facility may open to the public only on Saturdays and Sundays. At <br /> all other times, use of the facility shall be limited to members and <br /> their immediate families, and their bonafide guests, which shall not <br /> exceed one guest per member present. <br /> 16. The club shall file with the city its scheduled operations as it relates <br /> to all Sunday activities and to any regularly scheduled events within the <br /> facility in March of each year. The city shall be notified at least ten <br /> (10) days in advance of any Sunday during which extended hours will be <br /> used. <br /> 17. The owners shall hold the City of Hugo harmlessfrom any loss, expense, <br /> damage, including reasonable attorneys fees, that may be incurred as a <br /> result of granting the within Special Use Permit. <br /> 18. The owners shall provide the city with a performance bond in the amount <br /> of $5,000.00 to insure compliance with the conditions of the Special <br /> Use Permit. <br /> 19. The Special Use Permit will be reviewed on an annual basis. <br /> 20. The existing facilities are as shown on Exhibit A, and shall not be <br /> changed as herin provided. <br /> VOTING FOR: LaValle, Spitzer, Irsfeld, and Vail. <br /> VOTING AGAINST: Schletty. <br /> MOTION CARRIED <br />
