60 <br /> NOVEMBER 19, 1979 <br /> Santanni - Continued <br /> MOTION: Irsfeld made motion, seconded by LaValle, to grant a Temporary Mobile <br /> Home Permit to Mr. Santanni, 7124 125th Street, under Chapter 40, <br /> Article III, Subd. C, for a period of ninety (90) days. <br /> VOTING FOR: LaValle, Schletty, Irsfeld and Vail <br /> MOTION CARRIED <br /> 5.3 Ron Istvanovich - Cancelled <br /> 5.4 Mrs. Joel Ebert - REC Charge (Cancelled) <br /> 5.5 Neil McLean - Division of land on 170th Street <br /> Mr. McLean is the realtor involved in the sale of a 40 acre parcel along 170th Street <br /> in Section 12. The parcel would be divided into two 20 acre parcels, one of which <br /> is in the Agriculture zone and one in Conservancy. The back 20 acres does not have <br /> road frontage, so an easement would be required. Engineer Kuusisto stated that the <br /> easement should be 33' because the property is located on the quarter section line. <br /> McLean stated that the driveway would cross wetland and would require some fill. He <br /> was informed that Rice Creek Watershed would have to be contacted to obtain a permit <br /> to fill the land. LaValle stated that a registered land survey sould be submitted <br /> indicating the two parcels of property and a 33' easement to serve the back 20 acres. <br /> A land division would be required. <br /> 5.6 John Norton - Special Use Permit <br /> Mr. Norton is requesting to fill Lot 7, Block 1 , Royal haven Estates for the purpose <br /> of obtaining a building site. The Planning Commission forward the request without <br /> recommendation. Rice Creek would not provide a permit for Mr. Norton to fill the <br /> wetland on his property. He would be using less fill and have steeper slopes (2:1 ) . <br /> Kuusisto wondered how the entire area would look because of the filling. He thought <br /> that the wetland should be filled in order to make the area aesthetically beautiful, <br /> considering the value of the homes adjoining. Because of the 2:1 slopes, Kuusisto <br /> felt there should be provision for safety in relation to the ponding of the water on <br /> Norton's lot. The ordinance reads that no septic system, well, or building should <br /> be constructed closer than 100' from the high water mark, and Mr. Norton would not <br /> be able to meet this requirement. There is a provision for a variance of 1/3 the <br /> distance. Mr. Norton will be contacting Rice Creek to see if they will allow for <br /> the arrangement of the filling of his lot. <br /> MOTION: LaValle made motion, seconded by Irsfeld, to table the request of Mr. <br /> Norton until he requests the City Clerk place the matter on the agenda <br /> for further action. <br /> VOTING FOR: LaValle, Schletty, Irsfeld and Vail <br /> MOTION CARRIED <br />
