October 19, 1981 <br /> to have the work done. Washington County has requested a letter from the city clearing <br /> them of any responsibility. Kuusisto suggested two alternatives to the installation <br /> of a pipe: 1 ) installation of a dry well, or 2) an agreement from the property owner <br /> (Olinger) stating there will be no complaints from them regarding the ponding. <br /> Irsfeld stated that a restrictive covenant to the deed would be needed in case of <br /> any future sale of the Olinger property. Attorney Johnson stated that this would <br /> not solve the problem, but would give the city legal leverage. LaValle stated the <br /> problem could be addressed and hopefully resolved, within the requested 60 day <br /> extension. <br /> MOTION: McAllister made motion, seconded by Irsfeld, to grant an extension for <br /> the Shamrock Glen subdivision until December 7, 1981 , at the applicant's <br /> request. <br /> VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail <br /> MOTION CARRIED <br /> The applicant did submit a written request substantiating his verbal request. <br /> 5.7 Francis Peltier - Land Division <br /> MOTION: Irsfeld made motion, seconded by McAllister, to approve the Land Division <br /> for Francis Peltier, 13094 Goodview Avenue, to divide 20 acres into two <br /> 10 acre parcels, per the submitted Certificate of Survey. <br /> VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail <br /> MOTION CARRIED <br /> 5.8 Macklin, Beeman - Minor Subdivision <br /> The Minor Subdivision is needed to divide Parcel D from Parcel C, because of an <br /> encroachment. Mr. Johnson reviewed the submitted Certificate of Survey and deed, <br /> and gave them his approval. <br /> MOTION: Irsfeld made motion, seconded by LaValle, to approve the Minor Subdivision <br /> of Dennis and Linda Macklin and Gayle Beeman, to divide Parcel D from <br /> Parcel C, reason being encroachment of existing buildings over the property <br /> line. The deed has appropriate restriction that Lot D is not a buildable <br /> lot. <br /> VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail <br /> MOTION CARRIED <br /> 5.9 Energy Savers - Letter of Credit <br /> A letter of credit, in the amount of $14,000, has been submitted by Dennis Johnson, <br /> Energy Savers, and will be held by the city until he can obtain a performance bond. <br /> These financial guarantees are for the reroofing work to be done on City Hall. <br /> Mr. Johnson understands that there will be minimal pay out until the performance <br /> bond is received by the city. <br /> MOTION: LaValle made motion, seconded by Irsfeld, that Dennis Johnson, doing business <br /> as Energy Savers, be allowed to temporarily substitute a Letter of Credit <br /> for a performance payment bond. The Letter of Credit will be in force until <br /> the performance payment bond is received by the city. The city will sign <br /> the contract documents and the City Engineer will notify the contractor <br /> to proceed. <br /> VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail <br /> MOTION CARRIED <br />
