Miron stated that he does not mind the flea market as an interim use of the property with the <br />conditions that staff sets forward. He stated that the City has heard many complaints about <br />the condition of the property. He stated that all code requirements must be followed. <br />CD Director stated that outdoor retail is not allowed in the zoning district. He stated that Mr. <br />Sampair has asked to use it for a flea market on a temporary basis as long as all City <br />requirements are met. The site needs to be cleaned up prior to the flea market opening. There <br />will need to be a public hearing and work to be done with the Washington County Sheriffs <br />Department and the Hugo Fire Department. It may not be feasible for the time line they are <br />requesting. <br />Arcand stated that is done in Florida and thinks it is a good idea, but needs to be done <br />correctly. <br />Klein asked how long it will take to clean up the site. Mr. Sampair stated it will be cleaned <br />up by May 1, 2009. He went over the site plan for the flea market and the cleaning up of the <br />property. <br />Miron talked about an interim use permit in exchange for the property to be cleaned up and <br />put in compliance with City requirements. <br />Granger stated that they will be adding to the site with the flea market. The clean up of the <br />property and the flea market are two separate issues. We need to follow a process. They <br />should be required to clean up the site first and then come back and ask for approval of the <br />flea market. <br />Denaway asked for background on how the property got to be in a state that it needs to be <br />cleaned up. Mr. Sampair gave background on the lease situation with Mr. Glassel. <br />Miron asked if we can create an ordinance that will allow interim uses on property. CD <br />Director stated that staff has discussed this with the City Council and stated there is not a <br />process but it can be done. <br />Miron made a motion, seconded by Klein for staff to continue to work with the <br />representatives on the proposed flea market. <br />All aye. Motion Carried. <br />Mr. Glassel approached the EDA with a statement that there would not be alcohol and that <br />this will be a family event. <br />Granger talked about National Recycling being a nonconforming use in the zoning district. <br />Granger made a motion, seconded by Arcand, to get a written opinion from the City attorney <br />on the business being a nonconforming use. <br />All aye.
