MINUTES <br />HUGO BOARD OF ADJUSTMENTS AND APPEALS <br />DECEMBER 22, 2005 <br />Chairperson Schumann called the meeting to order at 6:38 p.m. <br />PRESENT: Brunotte, Schumann <br />ABSENT: Puleo <br />ALSO PRESENT: Bryan Bear, Community Development Director (CDD) <br />Michele Lindau, Community Development Assistant <br />Minutes of November 10, 2005 <br />Schumann made motion, Brunotte seconded, to recommend approval of the minutes of November <br />10, 2005 as submitted. <br />All Ayes. Motion carried. <br />Variance for Atkinson for a Side Yard Setback (Peloquin Industrial Park) <br />The Board considered the application of Dean and Ruby Atkinson, 13452 Goodview Avenue <br />North, for a variance to permit a 10 foot side yard setback on property owned by them in the <br />Peloquin Industrial Park. The property is located in the General Industrial Zoning District where <br />the minimum side yard setback is 40 feet. The parcel is 1.60 acres in size and located on the <br />north side of 152"d Street in the Peloquin Industrial Park. The applicant requested the 10 foot <br />side yard setback on the site so a new building or building addition can be constructed on the site <br />at a later date. <br />The CDD explained that the lot was 120 feet wide; most industrial lots are generally larger but the <br />Peloquin Industrial Park was an older park containing smaller lots. He noted that the Commission <br />and Council recently granted a setback variance for another parcel in the park. To comply with the <br />setback variance on the Atkinson site would leave only 40 feet for the width of the building. <br />Schumann asked why the ordinance required a 40 foot setback. And the CDD explained that the <br />intent was to have separation between buildings but agreed that 80 feet was excessive. <br />Schumann pointed out that larger buildings provide more tax base and 20 feet between buildings <br />would leave adequate room for emergency vehicles. <br />Brunotte made motion, Schumann seconded, to approve the variance and recommend the council <br />revisit the 40 foot setback requirement in the Industrial District. <br />All Ayes. Motion carried. <br />
