MINUTES <br />HUGO BOARD OF ADJUSTMENTS AND APPEALS <br />FEBRUARY 23, 2006 <br />Chairperson Schumann called the meeting to order at 6:38 p.m. <br />PRESENT: Brunotte, Puleo, Schumann <br />ABSENT: None <br />ALSO PRESENT: Bryan Bear, Community Development Director (CDD) <br />Michele Lindau, Community Development Assistant <br />Minutes of December 22, 2005 <br />Brunotte made motion, Schumann seconded, to recommend approval of the minutes of December <br />22, 2005 as submitted. <br />All Ayes. Motion carried. <br />Variance for Jones for Fence Setback <br />The Board considered the application of Todd and Heidi Jones, 15675 Fairoaks Avenue North, <br />for a variance to permit a six-foot high fence in a front yard setback on their property. The <br />property is a corner lot and has two front yards. The home faces Fairoaks Avenue and the fence <br />would be to the rear of the home along Falcon Circle North. The zoning ordinance prohibits <br />six-foot high privacy fences in a front yard. A front yard is defined as the yard between the <br />home and a public street. Ordinance limits the height of a fence located in a front yard to four <br />feet. <br />Staff had received a letter from Cities Management, Inc., who managed the Waters Edge <br />Homeowners Association, indicating the applicant would need to request approval from the <br />Association for any type of architectural change to the exterior of their homes and landscaping. <br />Todd Jones said he was not aware of the bylaws and if something was not specifically covered, <br />he understood it to be under the jurisdiction of City Ordinance. The fence had already been <br />constructed except for the gates. <br />Puleo said he understood the Building Official had made it clear he did not meet the ordinance to <br />put up the fence and Jones did it anyway. To approve the request because the fence was already <br />constructed was not a precedence the City wanted to set. <br />Brunotte made motion, Puleo seconded, to table the application to allow the applicant to work <br />with the Cities Management, Inc., to determine if approval from the Homeowners Association <br />was necessary. <br />
