MINUTES <br />HUGO BOARD OF ADJUSTMENTS AND APPEALS <br />June 8, 2006 <br />Chairperson Schumann called the meeting to order at 6:32 p.m. <br />PRESENT: Puleo, Schumann <br />ABSENT: Brunotte <br />ALSO PRESENT: Bryan Bear, Community Development Director (CDD) <br />Michele Lindau, Community Development Assistant <br />Minutes of April 27, 2006 <br />Schumann made motion, Puleo seconded, to recommend approval of the minutes of April 27, 2006 <br />as submitted. <br />All Ayes. Motion carried. <br />Variance for Matthew and Darla Tuil for a Deck <br />The Board considered the request of Matthew and Darla Tuil for a variance to permit a seven - <br />foot side yard setback, where 10 feet is required for construction of a 10 X 12 -foot deck on <br />property located at 6215 146th Street North (Rice Lake Meadow). The proposed deck would be <br />located on the east side of the home and would be accessed by an existing sliding glass door. <br />The home was constructed 17 feet from the east property line with a cantilevered bay with a sliding <br />glass door extending approximately two feet. The applicant wanted to construct a deck using the <br />existing glass door. At the time the homes were built in the Rice Lake Meadows subdivision, the <br />zoning code allowed encroachment of decks to a distance of not less than three feet from any lot <br />line. Therefore, decks on some of the homes in the development were within the ten -foot side yard <br />setback. <br />Other than the applicant, there was no one present to speak on the request. <br />Schumann made motion, Brunotte seconded, to recommend approval of the variance for a deck <br />at 6215 146th Street North. <br />All Ayes. Motion carried. <br />
