Board of Zoning Adjustments Meeting June 10, 2004 - page 2 <br />Palecek Variance for Accessory Building Exterior <br />The Board considered the application for John and Marie Palecek, 12506 Irish Avenue North, for <br />a variance to permit an accessory building with an exterior finish that is different than the <br />principal building. The property is located in the Rural Residential Zoning District on five acres. <br />In addition to the home, there was an existing 864 square foot accessory building located on the <br />property finished with vertical steel siding similar to the color of the home, which is horizontal <br />lap siding, beige in color. The applicant would like to construct an accessory building that would <br />be the similar in color to the house and existing accessory building. <br />When staff inspected the property it was noted that there were several porta-potties on the site. <br />Hugo City code does not permit this type of exterior storage and recommended the property be <br />brought into compliance prior to the issuance of a building permit. The CDD explained that if <br />the exterior storage was part of a home occupation, the applicant could apply for a conditional <br />use permit to allow the items to be stored inside the accessory building provided that all other <br />conditions were met. <br />John Palecek, the applicant, said he was the owner of Smilies Sewer Service and currently had 14 <br />porta-potties stored on his property. He indicated he would remove them prior to applying for a <br />building permit and would be applying for a conditional use permit to allow them to be stored in <br />the proposed accessory building. <br />Puleo made motion, Schumann seconded, to recommend approval of the variance for 12506 Irish <br />Avenue North with the condition the exterior storage is removed prior to the issuance of the <br />building permit. <br />All Ayes. Motion carried. <br />Miscellaneous Discussion <br />The CDD and Board discussed the interpretation of City Code Chapter 320, Section 1195-0.30, <br />Subd. 4, which requires that accessory buildings resemble the principal building on the lot. <br />The Board agreed that it was difficult to construct an accessory building that complied with this <br />requirement. The CDD asked how they felt about allowing City staff a greater degree of <br />discretion on these types of applications. <br />Schumann pointed out that problems could arise because residents had been required to obtain a <br />variance in the past and felt the City needed to provide an explanation on the range of discretion. <br />Puleo asked that they be informed by staff when items that would have gone to the Board in the <br />
