MINUTES <br />HUGO BOARD OF ADJUSTMENTS AND APPEALS <br />FEBRUARY 8, 2007 <br />Chairperson Schumann called the meeting to order at 6:30 p.m. <br />PRESENT: Brunotte, Schumann <br />ABSENT: Puleo <br />ALSO PRESENT: Bryan Bear, Community Development Director (CDD) <br />Rachel Simone, Associate Planner <br />Michele Lindau, Community Development Assistant <br />Minutes of December 14, 2006 <br />Brunotte made motion, Schumann seconded, to recommend approval of the minutes of December <br />14, 2006 as submitted. <br />All Ayes. Motion carried. <br />Variance for Gussett Design (Rick Burr) <br />The Board of Zoning considered the application of Rick Burr, owner of Gusset Design, 15587 <br />Forest Boulevard North, for two variances to permit construction of a 12,060 square foot <br />addition to an existing 5,740 square foot building used for office, warehousing, and <br />manufacturing. The addition would be used to warehouse equipment utilized by the business <br />and would provide storage for materials currently stored outside. <br />The Associate Planner explained one variance was from the side yard set back requirement to <br />allow the addition of the building to be one foot from the property line where thirty feet is <br />required, and the other variance was from the commercial/industrial construction standards to <br />build an addition with metal panels, which is prohibited by the ordinance. The applicant also <br />requested a concept plan review. <br />The current use is a legal non -conforming use. The property is zoned General Business (C-2) and <br />the use is industrial. In order to build the addition, the applicant would have to apply for a <br />conditional use permit to expand the legal non -conforming use during the site plan review and <br />must comply with the related performance standards. <br />An addition had been constructed in 1992 and a variance was granted to allow the building to be <br />three feet from the property line where the industrial zoning at that time required a 10 -foot <br />setback. The building was constructed at a slight angle, and to build an addition at the same <br />sight line, the setback would be 2'8" to 1'1" from the south property line. <br />
