MINUTES <br />HUGO BOARD OF ADJUSTMENTS AND APPEALS <br />April 26, 2012 <br />Chairperson Weidt called the meeting to order at 6:30 p.m. <br />PRESENT: Boland, Gwynn, & Weidt <br />ABSENT: None <br />ALSO PRESENT: Rachel Juba, Planner <br />Approval of Minutes <br />Weidt made motion, Gwynn seconded, to approve the minutes for October 13, 2011 as presented. <br />All Ayes. Motion carried. <br />Shaffer — Variance from Side Yard Setback for a Deck <br />Planner, Rachel Juba, described the application to the Board of Zoning. The applicant is requesting a <br />variance for a portion of a deck to be located 7 feet from the side property line, where 10 feet is <br />required by ordinance. The property is unique because of the shape of the lot. The two side lot lines <br />intersect in the back portion of the yard and form a point. The applicant has a sliding glass door and <br />deck ledger on the southern portion of the west (back) side of the house. The house is a common size <br />in the neighborhood and could not be built any closer to the front lot line by ordinance. With the <br />angle that the lot lines run along the side of the house, the construction of any reasonably sized deck <br />would encroach into the side yard setback. There is only a small corner of the deck that would <br />encroach 3 feet into the side yard setback, not the entire deck. It was in staff's opinion that the <br />applicant meets the requirements necessary to approve a variance and recommended approval of the <br />variance request. <br />Weidt opened the public hearing. Weidt noted that there was no one on the audience except for <br />the applicant. <br />The applicant, Grant Shaffer, stated that he talked to his neighbors about the variance request and <br />they seemed generally ok with his request. <br />Board member Boland asked the applicant where the stairs would be located. <br />The applicant stated that the stairs would be on the north side of the deck, therefore not <br />impacting the variance request. <br />Weidt closed the public hearing. <br />Gwynn motioned, Weidt seconded, to approve the variance request. <br />All Ayes, Motion Carried. <br />
