MINUTES <br />HUGO BOARD OF ADJUSTMENTS AND APPEALS <br />April 23, 2015 <br />Chairperson Weidt called the meeting to order at 6:28 p.m. <br />PRESENT: Boland, Weidt <br />ABSENT: Gwynn <br />ALSO PRESENT: Rachel Juba, Planner <br />Rachel Leitz, Community Development Intern <br />Approval of Minutes <br />Boland made motion, Weidt seconded, to approve the minutes for April 9, 2015, as presented. <br />All Ayes. Motion carried. <br />Petronack — Variance for accessory building location at 12997 Elmcrest Avenue N. <br />Planner, Juba, presented on the variance request to allow an accessory building to be placed in <br />front of the house, where the ordinance states that accessory buildings shall not protrude in from <br />of the principal building. The proposed accessory building would be 1,040 square feet and <br />would match the principal building in color and material. <br />Planner, Juba, described that the applicant owns two adjacent lots in the Kellison Addition <br />development. Both lots were planned and are allowed to have houses constructed on them. Juba <br />stated that the applicant is proposing to combine the lots into one parcel. The accessory building <br />is proposed to be located mostly on the vacant lot, not far from where the building site for a <br />house was planned. Juba described the accessory building to meet all applicable setback <br />requirements once the parcels are combined and that a condition of approval would be the <br />combination of the lots. Juba stated that the applicant is proposing a driveway from Elmcrest to <br />access the proposed accessory building. <br />Planner, Juba, described the criteria staff uses to evaluate variances, most notably: reasonable <br />use, unique circumstances, character of neighborhood, and spirit and intent. It was in staff's <br />opinion that there are practical difficulties in meeting the requirements for an accessory building <br />location. Juba concluded saying that staff recommends approval of the variance request for the <br />location of the accessory building. <br />Board member, Boland, wanted to verify the footprint of the structure that was as shown on the <br />plan was to scale with the actual structure. <br />Planner Juba stated everything was to scale. <br />Chairperson, Weidt, asked if there were any oppositions from neighbors on the variance request. <br />Planner, Juba, stated that she has received no calls regarding the proposed variance request. <br />
