HomeMy WebLinkAbout2014.06.02 CC MinutesMINUTES FOR THE CITY COUNCIL MEETING ON JUNE 2, 2014 Acting Mayor Petryk called the meeting to order at 7:00 p.m. PRESENT: Bronk, Haas, Klein, Petryk ABSENT: Weidt ALSO PRESENT: City Administrator Bryan Bear, City Attorney Dave Snyder, City Engineer Jay Kennedy, and City Clerk Michele Lindau May 19, 2014 City Council Meeting Klein made motion, Bronk seconded, to approve the minutes for the City Council meeting on May 19, 2014 as presented. All Ayes. Motion carried. May 19, 2014 Executive Session Petryk made motion, Bronk seconded, to approve the minutes for the City Council Executive Session on May 19, 2014 as presented. All Ayes. Motion carried. May 20, 2014 Health Partners Anniversary Celebration Bronk made motion, Klein seconded, to approve the minutes for the May 20, 2014 Health Partners Anniversary Celebration as presented. All Ayes. Motion carried. Approval of the Agenda Haas made motion, Klein seconded, to approve the agenda as amended. Add to administration presentations: Update on Hugo Good Neighbor Days Parade Add to Unfinished Business: Update on NRI Add to Council Presentations: Open House for Habitat for Humanity All Ayes. Motion carried. Update on Hugo Good Neighbor Days Parade Katie Riopel, the "Parade Lady", stated that she has been doing the parade for 19 years and this will be her last year. She encouraged anyone interested to step forward, or there will not be a parade next year. This year's theme is "wild, wild, west", and she invited the Council to be a part of the parade. The Council thanked her for all the years she has worked making the parade a success. Motion carried. Approval of Claims Adoption of the Consent Agenda approved the Claims Roster as presented. Approve Annual Performance Review for Utility Billing Clerk Jodie Guareschi Over the past 12 years, Jodie has worked as the City's Utility Billing Clerk in the Finance Department. Jodie also works as a member of the Hugo Fire Department as a firefighter/EMS responder. Adoption of the Consent Agenda approved the annual performance review for Utility Billing Clerk Jodie Guareschi. Approve Annual Performance Review for Public Works Worker Tom Smith Tom Smith was hired by the City of Hugo on June 26, 2000. Tom has worked the past 14 years on the Public Works department team. Adoption of the Consent Agenda approved the annual performance review for Public Works Worker Tom Smith. Approve Special Event Permit for Blue Heron Grill on June 27 & 28, 2014 The Blue Heron Grill, 14725 Victor Hugo Boulevard North, applied for a Special Event Permit to allow outdoor concerts on June 27 and 28, 2014. The bands will play under an outdoor tent set up in the parking lot, adjacent to the building, and will play from 7 p.m. -midnight. Staff has been working with the Blue Heron on the details of the events and finds the event to be well planned. Adoption of the Consent Agenda approved the Special Event Permit for the Blue Heron Grill for outdoor concerts on June 27 and 28, 2014. Hugo City Council Meeting Minutes for June 2, 2014 Page 3 of 7 Approve Resolution Approving Speed Study on Irish Avenue A resident on Irish Avenue contacted staff requesting a speed study be done on Irish Avenue from CSAH 8 to 147th Street. A road project was completed in the fall of 2012 to reclaim, grade, and pave the portion of Irish Avenue from CSAH 8 to the park entrance, with the remainder of Irish Avenue remaining gravel. Adoption of the Consent Agenda approved RESOLUTION 2014-16 AUTHORIZING THE MINNESOTA DEPARTMENT OF TRANSPORTATION (MNDOT) TO COMPLETE A SPEED STUDY ON IRISH AVENUE NORTH BETWEEN CSAH 8 AND 147TH STREET NORTH. Approve Resolution Approving Variance for Shimota at 9824 140th Street North Pat Shimota applied for a variance to construct a 1,600 square foot addition on an existing accessory building for property located at 9824 140th Street North. A past variance in 2003 allowed a maximum of four accessory buildings totaling 6,420 square feet on the property. The proposed variance would result in four accessory buildings on the property totaling 8,020 square feet. At its May 22, 2014 meeting, the Board of Zoning and Adjustments considered the request and held a public hearing. The Board concluded that the variance request met the necessary criteria and recommended Council approve the variance. Adoption of the Consent Agenda approved RESOLUTION 2014-17 APPROVING A VARIANCE TO CONSTRUCT A 1,600 SQUARE FOOT ADDITION ON AN EXISTING ACCESSORY BUILDING FOR PROPERTY LOCATED 9824 140TH STREET NORTH. Approve Completion of Probationary Status for Adam Sauerwein and Promotion to Regular Firefighter Adam Sauerwein has completed the necessary training and is in good standing with the Hugo Fire Department. Adam's two year probation ends on June 18th 2014. Adoption of the Consent Agenda approved removing Adam from probationary status and promoting him to the rank of firefighter effective June 18, 2014. Update on NRI Bronk added this to the agenda at the request of residents in the County Ponds development located across TH61 from the rail spur. Bronk stated that he has received several complaints on the noise from the site when NRI is loading rail cars. Petryk made motion, Klein seconded, to schedule a meeting for Tuesday, June 10, 2014 at 7 p.m. at Hugo City Hall to discuss NRI with concerned residents. All Ayes. Motion carried. Neighborhood residents in attendance asked to speak, and Acting Mayor Petryk allowed public comment. Paul Ford, 15880 Foxhill Avenue North, stated this was the third summer they are dealing with this. There was a neighborhood meeting last year and nothing has been resolved. NRI is operating a business that does not comply with City ordinance. It is time to set a deadline. Hugo City Council Meeting Minutes for June 2, 2014 Page 4 of 7 John Rotter, 13635 Fiona Avenue North, stated he was told several times that NRI would be cleaned up, but the pile is not getting smaller; it is getting larger. There is rust dust from dumping, and heavy metals and fuels draining on to ground into groundwater. Safety is a concern; there is no fencing. Metal is being pulled out of cars and being sent to recycling again. He stated that nothing is being done about the complaints, and the noise is keeping people awake. Cindy Petty, 13679 Fiona Avenue, stated she will be attending the meeting next week. They want to be able to enjoy their yards. They will not back down and will proceed with legal recourse if necessary. Pat Dunn, 13630 Fiona Avenue North, stated the noise is very annoying and needs to stop. Past minutes show that inspections have been done and nothing has changed. He was skeptical that the neighborhood meeting would lead to any results. He stated that the silt fence is down and he shouldn't be there doing City and EPA's work. Petryk thanked them for their input and said she appreciates that they will be at the workshop on Tuesday. City Administrator Bryan Bear gave a brief update. Meeting are being held with the owner of NRI to continue moving progress forward. Most of the scrap was gone last fall, but work couldn't be completed before winter set in. There have been discussions with the owner and contractor working on the site improvements, and there is an increase in activity with scrap being moved off the site so the contractor can finish the job. It is anticipated the improvements on the site would be done next month. Desire Rotter, 13635 Fiona Avenue North, said she has observed trucks leaving NRI after dumping at the rail spur, and then go south on TH61. NRI had said they would not be bringing large items into the site, but that is not the case. She is unable to use part of her yard because she does daycare and the children get scared. It has been going on too long. Neighbors are talking about selling, but property values are going down. This is not in the best interest of the neighbors. Haas stated he wants to see what options the City has for what is going on at that site, and provide vigilant compliance and enforcement. Update on Bald Eagle Lake Outlet On May 28, 2014, the Council met with the Rice Creek Watershed District Board at Hugo City Hall to discuss the Bald Eagle Lake Outlet structure. City Engineer Jay Kennedy provided an update to the Council. He stated the DNR included it on its priority list; however, it was not ranked high enough to be funded through the 2014 bonding bill. The total cost for the project is $600,000. Funding from the MnDOT Bridge Fund would cover $252,000 leaving $348,000 unfunded. Discussed at the meeting was ownership and maintenance of the dam, and how to partner with the RCWD. Some avenues of funding could be from the RCWD water quality fund if there is a water quality benefit. RCWD also has a Capital Improvement Program, and as flood control project, a portion of it could be funded through that. Staff is pulling together information Hugo City Council Meeting Minutes for June 2, 2014 Page 5 of 7 for the RCWD for them to evaluate this project. A letter has been sent to the DNR requesting a meeting to discuss funding and ownership of the structure with RCWD and Ramsey, Washington, and Anoka County. Haas spoke about the meeting held with the Ramsey, Anoka, and Washington County Commissioners on May 28th. The Commissioners indicated they would be asking their Boards to support correspondence to the DNR endorsing the City's efforts. Haas asked staff to request copies of the letters from the other Counties. City Administrator Bryan Bear stated that staff will be scheduling a meeting with the DNR. Petryk made motion, Klein seconded, to appoint Weidt and Petryk to attend this meeting, with Haas as an alternate. All Ayes. Motion carried. Update on Bonding Bill The City of Hugo requested $3 million be put into the bonding bill for three stormwater re -use projects to be done in the City of Hugo. City Administrator Bryan Bear and City Engineer Jay Kennedy had presented this to various groups at the capital, and seemed to get a warm reception; however, the approved bonding bill did not include these projects. Bear asked Council how they would like to move these projects forward. He suggested that staff presents some ideas to the water committee and report back to the City Council. Haas made motion, Klein seconded, to direct staff to provide a plan on how to implement water reuse projects and funding options for those projects. All Ayes. Motion carried. Update on the Rush Line Open House and Discussion on Alternatives The Council attended the Rush Line Open House on May 29, 2014 at the Forest Lake Service Center at 4:30 p.m. The purpose of the Open House was to gather input on the Rush Line Corridor project, specifically the study on the two proposed transit routes between St. Paul and Forest Lake. One option would involve bus rapid transit along the I -35E corridor. The other option would involve the rail corridor, terminating in White Bear Lake with the possibility of extending further north. The Rush Line Corridor Task force has appointed a policy committee and a technical committee to study both options. City Administrator Bryan Bear asked Council if they would like to provide feedback on a preferred route or alternatives to the two routes being proposed. Haas stated he was a member of this committee many years ago. Hugo is not in either of the options, and if Hugo wanted to be, they would need to reconsider their past decision to not be a part of the rapid transit taxing district, which he was not in favor of. The Council agreed they should not take a position, but continue to follow developments on the rail corridor. No formal action was taken. Hugo City Council Meeting Minutes for June 2, 2014 Page 6 of 7 Yellow Ribbon Network Update Council Member Chuck Haas and Phil Klein reported on the recent activities of the City of Hugo's Yellow Ribbon Network activities. Miles and Marilyn Stromberg are Hugo Good Neighbors of the year, much due to their volunteer work on the YRN. They will be Grand Marshals of the Good Neighbor Days Parade. This week is the 17th anniversary of D -Day. May Hamburger Night sponsors were WSB Engineering and Johnson & Turner Law Firm. June sponsor is Xcel Energy. Many thanks are still being received for the care packages sent by the YRN. Haas will be going to Norway with the National Guard to serve steaks to the troops. Open House for Habitat for Humanity Workshop Haas added this to the agenda to schedule a meeting of the Council to attend the Habitat for Humanity workshop to show the City's support for them and the homes they will be building on land donated by Schwieters Construction. Habitat for Humanity's Veteran Outreach Program is involving the Yellow Ribbon Network in the project. Haas made motion, Petryk seconded, to schedule a meeting for June 18, 2014 at 7 p.m. in the Oneka room to attend the workshop. All Ayes. Motion carried. Summary of Executive Session on May 19, 2014 At its May 19, 2014 meeting, the Council adjourned its regular session and entered into executive session for the purpose of conducting the performance review for City Administrator Bryan Bear. City Attorney Dave Snyder provided a summary, saying the executive session was for a routine performance review. Hugo Good Neighbor Days June 5-8, 2014 City Administrator Bryan Bear provided a reminder that the Hugo Lions will be holding the Hugo Good Neighbor Days Festival June 5-8, 2014 in Lions Park. The parade will be on Saturday, June 7th at 11 a.m. Parade route and information on Good Neighbor Days' events can be found on the City's website. Cancel Joint Meeting with Parks Commission Scheduled for June 11, 2014 At its May 5, 2014 meeting, the Council discussed Irish Avenue Park Planning and a recommendation from the Parks Commission to approve a public meeting be held to receive feedback on the development of the park. The Council had scheduled a meeting for June 11, 2014; however, the Parks Commission has since discussed refocusing their efforts to the development of Lions Park. Staff will cancel the meeting scheduled for Wednesday, June 11, 2014. Hugo City Council Meeting Minutes for June 2, 2014 Page 7 of 7 Oneka Ridge Golf Course Water Re -Use Irrigation Proiect Tours The Rice Creek Watershed District will be conducting tours of the water reuse project at the Oneka Ridge Golf Course. The tour for local decision makers is scheduled for Friday, August 8, 2014 from 9-10 a.m. with the back-up date of Friday, August 15th Haas made motion, Klein seconded, to schedule a meeting to attend the Oneka Ridge Golf Course project tour on Friday, August 8, 2014.
