HomeMy WebLinkAbout2014.10.20 CC MinutesMINUTES FOR THE HUGO CITY COUNCIL MEETING ON MONDAY, OCTOBER 20, 2014 Mayor Weidt called the meeting to order at 7:00 p.m. PRESENT: Bronk, Haas, Klein, Petryk, Weidt ABSENT: None ALSO PRESENT: City Administrator Bryan, Assistant City Attorney Josh Brekken, City Engineer Jay Kennedy, and City Clerk Michele Lindau Approval of Minutes for the October 4, 2014 Fire Department Open House Haas made motion, Bronk seconded, to approve the minutes for the Fire Department Open House on Saturday, October 4, 2014 as amended to mark Haas as absent. All Ayes. Motion carried. Approval of Minutes for the October 6, 2014 City Council Meeting Klein made motion, Petryk seconded, to approve the minutes for the City Council meeting on Monday, October 6, 2014 as presented. All Ayes. Motion carried. Approval of the Agenda Weidt made motion, Bronk seconded, to approve the agenda as amended by adding Connexus Energy's donation to Hugo Good Neighbor Food under Council Presentations. All Ayes. Motion carried BearPower Proiect — Allison Zomer Alli Zomer, Project Manager with HealthPartners/Children's Hospitals and Clinics, explained the community movement to address obesity trends in the U.S. called BearPower. BearPower is a program involving White Bear Lake Area Schools, including Oneka Elementary school, to promote healthy eating and being active. Since 2013, parents, schools, community organizations, local government officials, clinicians and local businesses have joined forces with Children's Hospitals and Clinics of Minnesota and HealthPartners to create a healthier environment for kids. BearPower works through partnerships, local events, and programs to make it easier for kids to eat well and be active in all the places they live, learn and play. Alli invited the City of Hugo to participate as a community partner. Haas made motion, Bronk seconded, to direct staff to work with Alli to draft something with all these points and present it at the next meeting for approval. All Ayes. Motion carried. Approve Minor Subdivision for Patrick Rooney at 12548 Keller Avenue North All Ayes. Motion carried. Approval of Claims Adoption of the Consent Agenda approved the Claims Roster as presented. Approve Annual Performance Review for Accounting Clerk Anna Wobse The City of Hugo hired Anna Wobse as the City's new Accounting Clerk on October 27, 2008. Over the past six years, Anna has worked under the direction of Finance Director Ron Otkin in accounts payable and payroll functions. Adoption of the Consent Agenda approved the annual performance review for Accounting Clerk Anna Wobse. Approve Retirement of Bill Buystedt from the Hugo Fire Department Fire Fighter Bill Buystedt has submitted his letter of resignation after 23 years and 4 months on the Hugo Fire Department. Adoption of the Consent Agenda approved the resignation of Bill Buystedt, effective November 1, 2014. Bronk made motion, Haas seconded, to invite Bill and his family to a future meeting to recognize him for over 23 years of service on the Fire Department. All Ayes. Motion carried. Approve Purchase of Dupre Property for CSAH 7/8 Right -of -Way At the May 13 and 20, 2013 meetings, Council discussed the portion of CSAH 8 that was not reconstructed as part of the CSAH 7 and 8 improvements because the 400 -foot long section was to be realigned. City staff and Washington County worked with the property owners, David and Patricia Dupre, on obtaining right -of way for the realignment of County Road 8 and had negotiated a purchase price based on $15,000 per acre for an approximately .49 acre easement. Adoption of the Consent Agenda approved RESOLUTION 2014- 33 AUTHORIZING THE PURCHASE OF .49 ACRES OF PROPERTY LOCATED AT CSAH 7/8 INTERSECTION FOR ROAD RIGHT-OF-WAY. Hugo City Council Meeting Minutes for October 20, 2014 Page 3 of 7 Approve Joint Powers Agreement with Washington County for Code Red On November 21, 2011, the Council approved the Joint Powers Agreement for the mass emergency communication system, CodeRED. CodeRED is a system where citizens are notified via telephone and text of natural disasters or City or County identified emergencies. The CodeRED system has been used several times in Hugo and found to be effective. The initial agreement between the Washington County Sheriff's Office and the City of Hugo will expire on December 31, 2014. The cost of the system will remain at $33,750 until the year 2019, and Washington County is requesting the City continue to partner with them at the same proportionate cost of $1,047.89 as last year. Adoption of the Consent Agenda approved the Joint Powers Agreement with Washington County Sheriff's Office for the CodeRED notification system. Approve Tobacco License for Steve and Linda Krueger dba Ebacco, LLC Steve and Linda Krueger have applied for a Tobacco License to open an E -cigarette shop at 14849 Forest Boulevard, Suite #5. The applicants own similar stores in Minnetonka and Alexandria, and would like to open a business at the Hugo location on November 1, 2014. Staff has received the appropriate licensing information and fee and is conducting a background check on the business owners. Adoption of the Consent Agenda approved the Tobacco License for Steve and Linda Krueger dba Ebacco, LLC., subject to satisfactory completion of the background investigation. Approve Minor Subdivision for Patrick Rooney at 12548 Keller Avenue North Patrick Rooney has applied for a minor subdivision for property located at 12548 Keller Avenue North. The proposal is to subdivide a 20 acre lot into two 10 acres lots. At its October 9, 2014 meeting, the Planning Commission considered the request and held a public hearing. Staff concluded that the proposal meets all the standards necessary for the City to approve a minor subdivision. Adoption of the Consent Agenda approved RESOLUTION 2014-34 APPROVING A MINOR SUBDIVISION FOR THE PROPERTY LOCATED AT 12548 KELLER AVENUE Discussion on Dam Safety Grant Agreement The City has been working with the Department of Natural Resources, the Rice Creek Watershed District, and others in an effort to secure funding for the replacement of the Bald Eagle Lake Outlet. The City has secured funding from MnDOT through the bridge bond funds, and received a commitment for a grant from the DNR pending approval of a grant agreement. City Engineer Jay Kennedy talked about the collaboration with the DNR and their commitment in the amount of $160,000, which is half the cost of the Dam itself. RCWD has indicated a funding commitment and will be considering an agreement at their October 22, 2014 meeting. The St. Paul Regional Water Services had responded in writing to the City's request for their assistance by saying that it would be best for Hugo representatives to present the request to the Board at the November 4, 2014 meeting. The City will continue to complete bridge inspections but does not commit the City to ownership or replacement, and this is stated in the agreement. Haas pointed out that the inspections are already being done by the city. Haas talked about the upcoming November 4th meeting of the SPRWS. He asked John Waller, RCWD Board Member and Hugo resident who was in the audience, if the RCWD knew the elevation of the outlet. Waller stated he did not know the answer but there is an ordinary high water level, which is generally what the public waters want to be maintained at. Haas said he would like to know the elevation for future conversations. He suggested someone attend the meeting of the SPRWS to try to get them on board to require something be done. Weidt made motion, Petryk seconded to direct Council Member Haas to attend the meeting of the SPRWS on November 4, 2014. All Ayes. Motion carried. Discussion on Policy for Remote Meeting Attendance At its January 14, 2014 meeting, Council adopted a policy for remote meeting attendance for a six-month trial period. This policy would allow a council member, commission member, or board member to be considered in attendance through interactive online media for the purpose of determining a quorum and participating in all proceedings. City Clerk Michele Lindau provided the background and explained what was in the draft policy. During the first quarter of 2014, Council Member Haas attended approximately five meetings remotely using Skype Bronk made motion, Klein seconded, to officially adopt the policy for remote meeting attendance. All Ayes. Motion carried. Yellow Ribbon Network Report Council Member Chuck Haas and Council Member Phil Klein reported to Council on the Yellow Ribbon Network activities held recently. The Hugo Area Business Association will sponsor Burger night on Wednesday, November 26, 2014. Haas thanked Floyd and Cindy Petty for working with the Lions Club on signs to advertise Hamburger Night. A Gold Star family member is doing an Eagle Scout project to honor his deceased brother. The project brings a service member with PTSD together with a companion dog. There will be a December 6, 2014 pheasant hunt for service members who will not be back in time for the November Welcome Home Pheasant Hunt. There will be a package event on November 15th. Wish list items can be dropped off at City Hall. Cindy Petty from the HBA stated that they will be providing chocolate chip cookies for Burger Night. Hugo City Council Meeting Minutes for October 20, 2014 Page 5 of 7 Connexus Energy Donation to Hugo Good Neighbor Food Shelf Council Member Haas added this to the agenda to inform Council that Connexus Energy is making a 25,000 donation to the Hugo Good Neighbor Food Shelf. This donation is being made in the memory of Jim Leroux, who was a long time member the Energy Board. Food Shelf Board Member Cindy Petty added that there are opportunities for other business owners to donate. She explained that there will be areas within the food shelf that can be sponsored, and the shopping area will be named after them. Haas made motion, Klein seconded, to directed staff to contact Connexus and the Food Shelf to make a presentation to thank Connexus and help publicize the need for donations. All Ayes. Motion carried. Weidt made motion, Petryk seconded, to direct staff to put together a letter to Connexus to thank them for supporting the community. All Ayes. Motion carried. Ground Breaking Ceremony Keystone Senior Living on October 21, 2014 City Administrator Bryan Bear reminded the Council they were invited to attend the Keystone Place at LaValle Fields Senior Housing Community Ground Breaking Ceremony on Tuesday, October 21, 2104 at 8 a.m. The ceremony will take place on the property located west of Lions Park. This was posted as a meeting. Hugo Area Business Association Networking Breakfast on October 22, 2014 City Administrator Bryan Bear reminded the Council of the Business Networking Breakfast on Wednesday, October 22, 2014 at 7:30 a.m. at the Blue Heron. The topic of the meeting will be tax and investment strategies. The Council had scheduled this as a meeting. Hugo Area Business Association Business Showcase at North Country Auto on October 28, 2014 City Administrator Bryan Bear informed the Council that the HBA was holding a Business Showcase at North Country Auto Body & Mechanical, 5451 140th Street North, on October 28, 2014. The Council was invited to join them for refreshments, shop tours, door prizes, and networking. The Showcase will take place from 4-6:30 p.m. Haas made motion, Klein seconded, to schedule it as a meeting of the Council. All Ayes. Motion carried. Hugo City Council Meeting Minutes for October 20, 2014 Page 6 of 7 Schedule Rice Lake Meadows Neighborhood Meeting for November 10, 2014 At its October 6, 2014 meeting, Council discussed the roadway CIP and directed staff to schedule a meeting with the Rice Lake Meadows neighborhood to determine their interest in a road project. City Administrator Bryan Bear suggested a meeting of the neighborhood residents be scheduled for Monday, November 10, 2014 at 6:30 p.m. following the Board of Canvass. Haas made motion, Bronk seconded, to schedule the Rice Lake Meadows neighborhood meeting for Monday November 10, 2014 at 6:30 p.m. All Ayes. Motion carried. Rice Creek Watershed District Citizen Advisory Committee City Administrator Bryan Bear informed the Council that the Rice Creek Watershed District is seeking applications for membership on its Citizen Advisory Committee (CAC). The CAC is appointed by the Board Managers to advise and assist them on all matters affecting the interests of the Watershed District and make recommendations on all contemplated projects and improvements in the District. Anyone interested in applying should contact Hugo City Hall or the Rice Creek Watershed District. Executive session on National Recycling, Inc. Assistant City Attorney Josh Brekken explained that the Council will enter into the executive session for the purpose of discussing strategies of claims and potential litigation related to National Recycling Incorporated's activities within the City and also at the rail spur location. Following the executive session, Council will return to the regular meeting. Haas made motion, Klein second, to enter into executive session at 8:10 p.m. All Ayes. Motion carried. The City Council reconvened the regular meeting at 9:20 p.m. Weidt made motion, Petryk seconded, to direct staff to work with the railroad and affected parties to develop permitting rules and regulations that will protect both citizen and business users of the rail spur, and have it completed within 45 days. All Ayes. Motion carried. Haas make motion, Klein seconded, to direct the EDA to take a look at what can be done to enhance and attract rail users, and take an active step to market aggressively.
