HomeMy WebLinkAbout2014.11.17 CC MinutesMINUTES FOR THE CITY COUNCIL MEETING ON MONDAY, NOVEMBER 17, 2014 Mayor Weidt called the meeting to order at 7:00 p.m. PRESENT: Haas, Klein, Petryk, Weidt ABSENT: None ALSO PRESENT: City Administrator Bryan Bear, City Attorney Dave Snyder, City Engineer Jay Kennedy, and City Clerk Michele Lindau November 3, 2014 Council Meeting Klein made motion, Haas seconded, to approve the minutes for the Hugo City Council meeting on November 3, 2014 as presented. All Ayes. Motion carried. November 10, 2014 Board of Canvass Petryk made motion, Klein seconded, to approve the minutes for the Board of Canvass on November 10, 2014 as presented. All Ayes. Motion carried. November 10, 2014 Rice Lake Meadows Neighborhood Meeting Petryk made motion, Klein seconded, to approve the minutes for the Rice Lake Meadows Neighborhood meeting as presented. All Ayes. Motion carried. Approval of the Agenda Weidt made motion, Klein seconded, to approve the agenda as presented All Ayes. Motion carried Habitat for Humanity (Generation Acres) Presentation City Administrator Bryan Bear explained that Habitat for Humanity recently acquired the remaining parcels in the Generation Acres townhome development, and he introduced Mike Nelson, Director of Land Development for Habitat for Humanity, to explain their plan for the site. Mike said they began having conservations with Schwieters Company less than a year ago regarding their donation of land to Habitat for Humanity. Habitat for Humanity's plan is to complete the development as it was approved and construct the remaining 33 units. Mike talked about the many programs that are a part of Habitat for Humanity and the other communities they Hugo City Council Meeting Minutes for November 17, 2014 Page 2 of 5 were building in. Habitat for Humanity hopes to begin work on nine housing units in Hugo next spring. Mike explained that Habitat provides mortgages that help make it affordable for families, and he explained the family selection process. Habitat also acts as the general contractors whose focus is to construct quality energy efficient homes. The homes would be similar to the existing eight units of housing already there. Approval of the Consent Agenda Haas made motion, Klein seconded, to approve the following Consent Agenda items: 1. Approval of Claims 2. Approve Resignation of Greg Teece from the Hugo Fire Department 3. Approve Resolution Approving the Dam Safety Grant Agreement 4. Approve Agreement for Subsurface Sewage Treatment System Inspection Services with Washington County 5. Approve Reduction in the Letter of Credit for OP3 Prairie Village LLC, Prairie Village 3rd Addition 6. Approve Resolution for Release of Actions on Generation Acres Plat for Habitat for Humanity Homes, Inc. All Ayes. Motion carried. Approval of Claims City staff recommends Council approve the Claims Roster as presented. Approve Resignation of Greg Teece from the Hugo Fire Department Firefighter Gregory Teece of the Hugo Fire Department has submitted his letter of resignation. Adoption of the Consent Agenda approved the letter of resignation effective October 23, 2014. Approve Resolution Approving the Dam Safety Grant Agreement At its October 20, 2014 meeting, Council approved the Dam Safety Grant Agreement with the DNR in the amount of $160,000. In order to execute the agreement, a resolution is required. Adoption of the Consent Agenda approved RESOLUTION 2014-37 APPROVING THE DNR DAM SAFETY PROGRAM GRANT AGREEMENT. Approve Agreement for Subsurface Sewage Treatment System Inspection Services with Washington County The City of Hugo received notification the Subsurface Sewage Treatment System Inspection Services Agreement with Washington County expires on December 31, 2014. This agreement is a two-year contract with the City to provide inspection services for individual sewage treatment systems. Washington County Ordinance 179, Subsurface Sewage Treatment Systems Regulations Ordinance (SSTSRO) and the agreement have been reviewed by City staff and found to be satisfactory. Adoption of the Consent Agenda approved the agreement with Hugo City Council Meeting Minutes for November 17, 2014 Page 3 of 5 Washington County to provide inspection services for individual septic systems in the rural area of Hugo. Approve Reduction in the Letter of Credit for OP3 Prairie Village LLC, Prairie Village 3rd Addition OP3 Prairie Village, developer, has requested the City reduce the letter of credit being held for the Prairie Village 3rd Addition. Senior Engineering Technician Steve Duff had inspected the work and recommended approval. Adoption of the Consent Agenda approved the reduction of the letter of credit being held for the constructed improvements in the Prairie Village 3rd Addition be reduced to $655,480.17 of the original letter of credit $1,393,000.00. Approve Resolution for Release of Actions on Generation Acres Plat for Habitat for Humanity, Inc. In 2008, the developer of Generation Acres was in default of the Development Agreement in regard to completing installation of the required public improvements. Prior to the expiration, staff attempted to draw on the LOC and the financial institution failed to honor the LOC. In an effort to preserve the City's authority to obtain the funds, the City Council passed a Resolution in regard to the incomplete public improvements. This does not allow municipal action of any kind to be issued within the plat until the requirements within the Development Agreement are satisfied. Habitat for Humanity recently acquired the remaining property in Generation Acres. Habitat for Humanity has requested that the City Council release the Generation Acres plat from the Resolution that does not allow municipal action to occur. Habitat for Humanity has satisfied the requirements within the Development Agreement and staff is comfortable releasing the plat from the resolution. Adoption of the Consent Agenda approved RESOLUTION NO. 2014-38 APPROVING NOTICE REGARDING A RELEASE FROM CERTAIN ACTION FOR THE PLAT OF GENERATION ACRES. Approve Annual Snowmobile Trail Application for the Hugo Snowmobile Club and the Rice Creek Trail Association. Each year, the Hugo Snowmobile Club and Rice Creek Trail Association submit applications to the City for the purpose of providing public recreational snowmobile trails during the winter. Staff recommended Council approve the 2014-2015 annual trail applications from the snowmobile clubs as proposed subject to proper insurance and written permission for new trail connections. Council Member Petryk removed this from the Consent Agenda to hear from the Hugo Snowmobile Club representatives who were in the audience. Hugo Snowmobile Club President John Udstuen talked about the reopening of a trail that was closed last year, and he thanked the Bramstedt family for their cooperation. He also thanked the Arcand family for allowing the trail to go through their property north of 130th Street. He stated that the Snowmobile Club provides recreational support to the community, and he feels they are doing what the community wants. He explained that changes to the route include access to the Blue Heron, Qwik Trip, and the American Legion, as requested by the establishments. Weidt made motion, Petryk seconded, to approve the Snowmobile Trail Applications for the Hugo Snowmobile Club and Rice Creek Trail Association. All Ayes. Motion carried. Update on Rice Lake Meadows Neighborhood Meeting on November 10, 2014 On Monday, November 10, 2014, residents in the Rice Lake Meadows neighborhood attended a meeting with Council and staff to discuss a potential street project. City Engineer Jay Kennedy stated that the meeting was not very well attended due to the inclement weather. A decision had been made to reschedule the meeting and revise the notice to residents to include more information on the proposed project and proposed assessments. Haas made motion, Klein seconded, to schedule another meeting of the residents in the Rice Lake Meadows neighborhood for December 8, 2014 at 7 p.m. Motion carried. Approve Resignation of Tony Bronk from the Hugo City Council and Declare Vacancy On November 13, 2014, Tony Bronk submitted his letter of resignation from the Hugo City Council effective immediately. Bronk served as the Council Member at Large. City Administrator Bryan Bear explained that State Statute requires Council approve a resolution declaring a vacancy on the Council. Statute also requires an appointment be made to fill the vacancy. The specific steps in the appointment process are not outlined in the statute, and Bear provided some options for the Council to consider. Weidt made motion, Klein seconded, to approve RESOLUTION 2014-39 ACCEPTING RESIGNATION AND DECLARING A VACANCY ON THE HUGO CITY COUNCIL. All Ayes. Motion carried. Weidt made motion, Klein seconded, to direct staff to post the vacancy until December 5, 2014 and schedule a workshop to conduct interviews on Tuesday, December 9, 2014 at 7 p.m. All Ayes. Motion carried. Update on Yellow Ribbon Network Council Member Chuck Haas and Council Member Phil Klein reported to Council on the Yellow Ribbon Network activities held recently. A MN Packers Team held a packing event last Friday night and Saturday. Since July of 2012 the YRN has packed and shipped over 700 packages to the troops. Hamburger Night on November 26th will be sponsored by Thompson Reuters from 5- 9 p.m. At the December 15, 2014 Council meeting, all sponsors will be recognized. Hugo City Council Meeting Minutes for November 17, 2014 Page 5 of 5 HBA Business Showcase on Tuesday, November 25, 2014 The Hugo City Council is invited to the Hugo Area Business Association Showcase on Tuesday, November 25, 2014 at Gator Signs from 4-5 p.m. Gator Signs is located at 31 2nd Avenue NE, Forest Lake. Treats, shop tours, and demonstrations will be available. Council Member Haas mentioned that Gator Signs had donated the signs advertising Hamburger Night. Petryk made motion, Klein seconded to schedule the HBA Showcase on November 25, 2014 as a City Council meeting. All Ayes. Motion carried.
