HomeMy WebLinkAbout2013.05.20 CC MinutesMINUTES FOR THE CITY COUNCIL MEETING ON MAY 20, 2013 Mayor Weidt called the meeting to order at 7:03 p.m. PRESENT: Bronk, Haas, Klein, Petryk, Weidt ABSENT: None ALSO PRESENT: City Administrator Bryan Bear, City Attorney David Snyder, City Engineer Jay Kennedy, Finance Director Ron Otkin, Accounting Clerk Anna Wobse, and City Clerk Michele Lindau Moment of Silence for Tornado Victims May 25, 2013 will mark the fifth anniversary of the F3 tornado that struck Hugo, claiming the life of Nathan Prindle and destroying over 150 homes. Mayor Weidt called for a moment of silence to remember the victims of that tornado and the one that struck Oklahoma City earlier on this day, May 20, 2013. Approval of the Minutes for the May 6, 2013 City Council Meeting Klein made motion, Petryk seconded, to approve the minutes for the May 6, 2013 City Council meeting as presented. All Ayes. Motion carried. Approval of the Minutes for the May 9, 2013 Roundabout Workshop Petryk made motion, Klein seconded, to approve the minutes for the May 9, 2013 Roundabout Workshop as presented. All Ayes. Motion carried. Approval of the Agenda Weidt made motion, Haas seconded, to approve the agenda as amended: Add under Council Presentations: Road Striping on TH61 in Front of US Bank Add under New Business: Discussion on Purchase Agreement for Former Carpenters Property Add under Administrative Presentation: Rescheduling of Water Conservation Workshop All Ayes. Motion carried. Bayport American Legion Donation to the Yellow Ribbon Network and Soaring Eagles Bayport American Legion Gambling Manager and Commander Wayne Peterson presented checks to the Yellow Ribbon Network (YRN) and Soaring Eagles in the amount of $1,500 each, and a check to the Hugo Fire Department in remembrance of the Hugo Tornado for $2,500 to purchase emergency equipment. Bayport American Legion conducts gambling at Sal's Angus Grill in the form of pull tabs, bingo, and meat raffles, which volunteers of the YRN assist in. Marion commented that the use of electronic pull tabs have doubled their sales. Members of the Hugo City Council Meeting Minutes for May 20, 2013 Page 2 of 8 YRN were in attendance to accept the checks for the YRN and Soaring Eagles. The Council thanked them for the donation. WBL Chamber of Commerce Board Chair Scott Mueller and Executive Director Tom Snell Tom Snell, the new Executive Director of the White Bear Lake Area Chamber, and Board Chair Scott Mueller addressed the Hugo City Council to discuss the Chamber's vision for the future and their role on Economic Development issues facing the area. They explained the Chamber encompasses cities from Maplewood to Forest Lake. They talked about their involvement in the White Bear Lake Resolution Committee and their effort to engage the business community in water conservation. Scott talked about the Grow Minnesota initiative which is the Minnesota Chamber's business assistance program that will visit companies to talk about business expansion and retention. Council discussed with them the role the DNR and Met Council play in water conservation, and they talked about the increases in property taxes on business. Hugo City Council Meeting Minutes for May 20, 2013 Page 3 of 8 Approval of Claims Adoption of the Consent Agenda approved the Claims Roster as presented Approve Annual Performance Review for Public Works Worker Rick Kieffer Rick Kieffer was re -hired by the City of Hugo on May 31, 2005, returning after a short period of time in the private sector. Over the past eight years, Rick has worked under the direction of Public Works Director Scott Anderson. Adoption of the Consent Agenda approved the Annual Performance Review for Public Works Worker Rick Kieffer. Approve Pay Request No. 9 to Municipal Builders, Inc. for Well House No. 6 The City has received Pay Request No. 9 from Municipal Builders, Inc. for work on Well House No. 6. Senior Engineering Technician Steve Duff and City Engineer Jay Kennedy have reviewed the pay request and found it to be satisfactory for work completed to date on the project. Adoption of the Consent Agenda approved Pay Request No. 9 from Municipal Builders, Inc. in the amount of $5,452.05 for work completed on Well No. 6. Approve Application for Water Surface Use Permit for David Strub on Sunset Lake On behalf of the residents on Sunset Lake, Dave Strub made application to the City of Hugo for a water surface use permit for a slalom water ski course on the lake. Washington County Sheriff's Department has provided the application form that has been completed by Dave Strub. Adoption of the Consent Agenda approved the application for a water surface use permit on Sunset Lake for the homeowners to hold water skiing events on the slalom course. Approve Advertisement for Community Development Intern Liz Hanson was hired as a Community Development Intern on May 21, 2012. Liz has recently accepted an intern position at the City of Blaine, and will continue to work afternoons at the City of Hugo on Tuesdays and Thursday until May 30, 2013. Adoption of the Consent Agenda approved the advertisement for a new Community Development Intern. Approve Minor Subdivision and Variance for 7131132 nd Street North The applicant is requesting approval of a minor subdivision and variance of a 19.36 acre parcel located at 7131 132nd Street North. The minor subdivision will split the 19.36 acre parcel into a 10 acre parcel and 9.36 acre parcel. The variance is for the size of the 9.36 acre parcel, where the minimum lot size is 10 acres in the Rural Residential (RR) zoning district. At its May 20, 2013 meeting, the Planning Commission considered and held a public hearing on the applicant's request. There was no one that spoke at the public hearing besides the applicant. Adoption of the Consent Agenda approved RESOLUTION 2013-17 APPROVING A MINOR SUBDIVISION FOR THE PROPERTY LOCATED AT 7131 132ND STREET NORTH and RESOLUTION 2013-18 APPROVING A VARIANCE FROM THE LOT SIZE REQUIREMENTS IN THE RURAL RESIDENTIAL (RR) ZONING DISTRICT FOR SCOTT MONTGOMERY ON THE PROPERTY LOCATED AT 7131132ND STREET NORTH. Hugo City Council Meeting Minutes for May 20, 2013 Page 4 of 8 Approve Washington County CSAH 4 Pavement Rehabilitation Proiect Washington County included roadway improvements to County Road 4A between Highway 61 and the west County line in their Capital Improvements Program for 2013. County staff submitted the plans to the City for review, and City staff is comfortable with the plans as presented. The project will include full -depth reclamation and repaving, will take place concurrently with the Highway 61/CSAH 4 intersection improvements, and will be funded by Washington County. Adoption of the Consent Agenda approved the Washington County CSAH 4 Pavement Rehabilitation Project. Approve Wetland Replacement Plan for Christ Lutheran Church Phase 1 of the Christ Lutheran Church development project includes a proposal to fill 12,700 square feet of wetland associated with the construction of a church and parking lot. The applicant is proposing to purchase wetland bank credits at a 2:1 mitigation ratio in -advance of the proposed wetland impacts. The applicant is also seeking a no -loss decision approval for non- regulated wetland impacts. These impacts consist of excavating one wetland area. City staff has determined that the proposed wetland impacts are eligible for a no -loss decision, and avoidance and minimization for the proposed 12,700 square feet of unavoidable wetland impacts are sufficient, in accordance with the sequencing and replacement plan requirements under MN Rules 8420. Adoption of the Consent Agenda approved the Christ Lutheran Church- Phase 1 replacement plan, no -loss determination, and sequencing decision. Approve Application from the Hugo American Legion to Conduct Off -Site Gambling During Hugo Good Neighbor Days City staff has received an application for a Lawful Gambling License from the Hugo Lion's Club in order to conduct raffles and bingo at its annual Good Neighbor Days scheduled for June 6-9, 2013. City staff has reviewed the application and found it to be satisfactorily complete. Adoption of the Consent Agenda approved the Lawful Gambling License for the Hugo Lion's Club in order to conduct lawful gambling at its annual Good Neighbor Days event scheduled for June 6-9, 2013. Approve Resignation of Firefighter Chris Schwanke Hugo Firefighter Chris Schwanke has submitted his letter from the Hugo Fire Department effective May 16, 2013 due to his family moving out of the area. Adoption of the Consent Agenda approved the resignation of Firefighter Chris Schwanke. Approve Leave of Absence for Firefighter Matt Richardson Hugo Firefighter Matt Richardson is requesting a Leave of Absence with an anticipated return date of September 1, 2013. Adoption of the Consent Agenda approved the Leave of Absence for Firefighter Matt Richardson effective May 22 -September 1, 2013. Hugo City Council Meeting Minutes for May 20, 2013 Page 5 of 8 Approve Appointment of Jim Fordham as the New Safety Captain on the Fire Department At its April 15, 2013 meeting, the Council approved the appointment of Jim Compton Jr. as the new Deputy Fire Chief. Jim was the Safety Captain for the Fire Department, and his appointment as Deputy Chief left that position vacant. Adoption of the Consent Agenda approved appointment of Firefighter Jim Fordham as the new Safety Captain on the Hugo Fire Department. Approve Letter to Washington County to Include a Portion of CSAH 8 in their CIP At its May 6, 2013 meeting, the Council granted municipal consent to Washington County for the CSAH 7 roadway reconstruction project. At that time, the Council discussed the 400 -foot long section of CSAH 8 that connects to CSAH 7 that was not improved as part of the CSAH 8 project in 2010 because that section was to be realigned according to plan. Staff believes that the property owner affected by the realignment is willing to work with the County/City on right-of- way for the project. Staff has drafted a letter to Washington County requesting this be included in the Washington County CIP. Council Member Haas removed this from the Consent Agenda to recommend changes to the letter. He recalled the conversation with Washington County at the time CSAH 8 was improved. The County said the road would be realigned as part of the future CSAH 7 improvements. He also wanted it noted that Hugo will assist with the right-of-way acquisition. Haas made motion, Petryk seconded, to direct staff to make the changes and send the letter to Washington County. All Ayes. Motion carried. Approve MS 150 Bike Ride through Hugo on June 9, 2013 The National MS Society holds a 150 -mile bike ride from Duluth to the Twin Cities each year in June. The event is a fundraiser with proceeds going to finding a cure for Multiple Sclerosis. This year, riders will be heading south through Hugo on Sunday, June 9, 2013. Event organizers have been working with MnDot and have applied to Washington County for the use of the Hardwood Creek Trail for this event. Resident Cindy Petty asked what the impact would be on the Good Neighbor Days celebration on that Sunday. Staff explained riders are very spread out on the trail when coming through Hugo, and there has never been a problem in the past. Haas made motion, Klein seconded, to approve the annual MS 150 Bike Ride through Hugo on June 9, 2013. All Ayes. Motion carried. Hugo City Council Meeting Minutes for May 20, 2013 Page 6 of 8 Discussion on Revised Assessment Policy At its Tuesday, April 9, 2013 workshop, Council discussed the Assessment Policy and proposed changes to include assistance in developer -driven roadway and associated improvements. Council had directed this to be brought to the Planning Commission for a public hearing and to the EDA. City Administrator Bryan Bear updated the Council on these meetings and presented the revised assessment policy for approval. Bryan explained the assessment policy discussion began when the City approved a site plan application for Christ Lutheran Church, which is part of the Frenchman Place development. A condition in the Development Agreement requires Rosemary Way be constructed. Tighter lending regulations are making it difficult for the developer to get the financing. Developer Len Pratt submitted a petition requesting the City build the street and assess the cost back to the property owned by him. Bryan discussed with council the benefits and consequences of financing developer driven road projects. He presented the proposed Exhibit A to the Council that contains items to minimum the risk to the City, which include a 60% Letter of Credit, no deferred assessments, and mortgage consent. The Planning Commission discussed the proposed policy at their April 25th and May 9th meetings and recommended approval. The EDA discussed this at their May 13th meeting and questioned whether it should be more aggressive by including the extensions of public utilities. The Council discussed this and concluded to not be more aggressive at this time. Klein made motion, Petryk seconded, to approve Exhibit A to the Assessment Policy. All Ayes. Motion carried. Staff will make the necessary changes to the policy and present a resolution adopting the revised policy for Council approval at their next meeting. Discussion on Purchase Agreement for Former Carpenters Property The City Council has considered the purchase of the former Carpenters property, 14559 and 14583 Forest Boulevard North, on several occasions, and the property will now be facing tax forfeiture in June, 2013. The City had just received a purchase agreement signed by owner Cathy Anderson on this day, and City Administrator Bryan Bear added it to the agenda for Council to consider. Bryan explained there are five parcels totaling 1.34 acres. The maximum purchase price is $285,000 which includes back taxes, assessments, mortgages, and other encumbrances. With the purchase of the property, $47,000 of the assessments would be returned to the City and 1/3 of the back taxes. Staff will negotiate with Washington County the amount of interest and penalties that will need to be paid to them on the taxes. If the City chooses not to buy it, it will be tax forfeited and the DNR could take ownership, or the County could sell it at fair market value. Purchase of the property would allow it to be developed along with existing City owned land to the north. Staff has found there are title issues on the south parcels of the Carpenter property. Closing will take place on the north parcels first, followed by closing on the southern parcels once issues have been resolved. Hugo City Council Meeting Minutes for May 20, 2013 Page 7 of 8 Klein made motion, Haas seconded, to approve the purchase agreement for the former Carpenters property. Haas made motion, Klein seconded, to amend the motion to allow for staff to make changes, if necessary, to enhance the purchase price or terms of the agreement. Vote on amendment - All Ayes. Update on the Yellow Ribbon Network Council Member Chuck Haas and Phil Klein provided Council an update on the City of Hugo's Yellow Ribbon Network (YRN) activities. The YRN has received a Certificate of Appreciation from soldiers in Kuwait. Hamburger Night Wednesday, May 22, 2013 will be sponsored by the Hugo Business Association Networking Group. The YRN contributed to Gold Star Weekend. The Hugo American Legion will hold memorial services on Monday, May 26, 2013 in observance of Memorial Day. A golf outing is being planned and donations are being accepted for the next care packaging event. Road Striping on TH61 in Front of US Bank Council Member Haas added this to the agenda to talk about the striping in the center of TH61 in front of the US bank. The portion that is striped is narrower than a car, and cars traveling south turning into US Bank are being passed on the right illegally. Haas made motion, Petryk seconded, to direct the City Engineer to look into it and look at alternatives to the current striping. All Ayes. Motion carried. Vacancy on the Brown's Creek Watershed District City Administrator informed the Council that the City has been notified of a vacancy on the Brown's Creek Watershed District. Anyone living in this district and interested in serving on the Board should contact the City or Washington County. EDA Interviews and City Administrator Performance Review on Tuesday, May 21, 2013 City Administrator Bryan Bear provided a reminder to the Council of the scheduled interviews for the vacancy on the EDA and the City Administrators performance review for Tuesday, May 21, 2013. The interviews will begin at 7:00 p.m. with the review to follow at approximately 8:00 p.m. Hugo City Council Meeting Minutes for May 20, 2013 Page 8 of 8 Christ Lutheran Church Groundbreaking on Sunday, June 2, 2013 Christ Lutheran Church has invited the Council to attend their Ground Breaking Ceremony at the site of their new church at 4790 Rosemary Way. A potluck provided by the Church will be at 5:00 p.m. with the Ground Breaking Ceremony at 6:00 p.m. Petryk made motion, Klein seconded, to schedule a meeting of the Council for Sunday, June 2, 2013 at 5:00 p.m. to attend the Christ Lutheran Church Groundbreaking Ceremony. All Ayes. Motion carried. Rescheduling of Water Conservation Workshop At its May 6, 2013 meeting, Council scheduled a workshop to discuss water conservation for Tuesday, June 4, 2013. Mayor Weidt added this to the agenda to reschedule this due to a conflict in his schedule. Weidt made motion, Klein seconded, to schedule the Water Conservation Workshop for Tuesday, June 18, 2013 at 5:30 p.m. at Hugo City Hall. All Ayes. Motion carried.
