HomeMy WebLinkAbout2012.11.05 CC MinutesMINUTES FOR THE CITY COUNCIL MEETING ON MONDAY, NOVEMBER 5, 2012 Mayor Miron called the meeting to order at 7:07 p.m. PRESENT: Haas, Klein, Petryk, Weidt, Miron ABSENT: None ALSO PRESENT: City Administrator Bryan Bear, Assistant City Attorney Josh Brekken, and City Clerk Michele Lindau Boy Scout Troop 151 Prior to the meeting, City Administrator Bryan Bear, Mayor Fran Miron, and Council Tom Member Weidt met with local Boy Scout Troop 151 to talk to them about the role of city government. The troop was working towards earning their Civics Badge. Mayor Miron invited Scout Jacob Michelson to sit at the dais as Honorary Mayor, and Scout Zachary Reich to lead the Council in the Pledge of Allegiance, Approval of Minutes for October 15, 2012 City Council Meeting Weidt made motion, Klein seconded, to approve the minutes for the October 15, 2012 City Council meeting as presented. All Ayes. Motion carried. Approval of the Agenda Miron made motion, Haas seconded, to approve the Agenda as amended. Approval of Claims Adoption of the Consent Agenda approved the Claims Roster as presented. Approve Annual Performance Review for Building Official Chuck Preisler Chuck Preisler was hired by the City of Hugo as the new Building Inspector on November 29, 2004 and was promoted to Building Official when John Benson retired in April 2010. Adoption of the Consent Agenda approved the annual performance review for Building Official Chuck Preisler. Approve Deferral of Assessment for Lake Air/Bald Eagle Estates Improvement Project for Rene & Margaret Nadeau On October 14, 2012, the City of Hugo Finance Department received an application for Deferment of Special Assessments signed by Rene and Margaret Nadeau at 12400 Europa Avenue North. The Nadeaus are requesting that the assessment for the Lake Air/Bald Eagle Estates Improvement Project be deferred as per the terms of the approved Assessment Policy. Adoption of the Consent Agenda approved the Application for Deferment of Special Assessment for Rene and Margaret Nadeau. Approve Appointment of Trina Oswald as a Regular Member of the Historical Commission Trina Oswald has been serving as an Associate Member on the Historical Commission since October 2, 2006. With the resignation of Marvella Gamboni from the Historical Commission, Historical Commission Chair Kitty Cheesebrow recommended appointment of Associate Member Trina Oswald. Adoption of the Consent Agenda approved Trina Oswald to serve as a regular member on the Historical Commission to complete the term of Marvella Gamboni to expire on December 31, 2013. Approve Auto Dismantling License for Hugo Auto & Truck Parts The City of Hugo has received an application for the bi-annual Auto Dismantling License from Mike Brandt, dba Hugo Auto and Truck Parts. As a requirement of the license, City staff makes an annual inspection of the auto dismantling company for compliance with city, county, and state code. On October 18, 2012 Hugo City staff completed the inspection and found it to be in compliance with City Code as well as County regulations. As a requirement of the license, City staff makes an annual inspection of the auto dismantling company for compliance with city, county, and state code. Approve Resolution Approving Washington County All Hazards Mitigation Plan The Washington County Sheriff's Department is requesting the City of Hugo formally adopt the All -Hazard Mitigation Plan. The purpose of the plan is to identify hazards, risks, and vulnerabilities throughout the county and determine how to reduce, minimize or eliminate the loss of life and property damage resulting from a variety of hazards — natural, technological, and human -caused. The plan also analyzes municipal capabilities and local, state, and federal resources in relation to the risks and vulnerabilities posed by each hazard. Review of this plan by the State of Minnesota Division of Homeland Security and Emergency Management (HSEM) and final approval by the Federal Emergency Management Agency (FEMA) will make Washington County and the municipalities that adopt this plan eligible for Hazard Mitigation Grant Program (HMGP) project funds. These funds may help to offset the costs of the mitigation projects set forth in the plan. Adoption of the consent Agenda approved RESOLUTION 2012-32 ADOPTING THE WASHINGTON COUNTY ALL -HAZARD MITIGATION PLAN. Approve the Lawful Gambling Exempt Permit for Warm Hearts for Charity Event on January 19, 2013 The Hugo Business Association applied for a Lawful Gambling Exempt Permit to allow raffles at their Warm Hearts for Charity Event to be held a the Hugo American Legion on Saturday, January 19, 2013. Adoption of the Consent Agenda approved the Lawful Gambling permit for the Warm Hearts for Charity Event. Approve Letter of Recommendation for Reappointment of John Waller to the Rice Creek Watershed District Board The City of Hugo has been informed by Washington County that the term of Manager John Waller, who serves on the Rice Creek Watershed District (RCWD) Board, will expire January 18, 2013. John has represented the City of Hugo on the RCWD for the past six years and desires reappointment. Adoption of the Consent Agenda approved a letter of support to reappoint John Waller for another three-year term on the RCWD Board of Managers. Approve Final Payment Request From E.H. Renner and Sons for Well Modifications The City contracted E.H. Renner and Sons to modify two existing monitoring wells for the purpose of installing long term ground monitoring equipment. Adoption of the Consent Agenda approved payment in the amount of $968.85 to E.H. Renner and Sons. Hugo City Council Meeting Minutes for November 5, 2012 Page 4 of 7 Approve Pay Request No.11 from E.H. Renner and Sons, Inc. for Well No. 6 The City has received pay request No. 11 from E.H. Renner and Sons for construction on Municipal Production Well No 6. Adoption of the Consent Agenda approved payment in the amount of $11,878.09 to E.H. Renner and Sons. Approve Resignation of Lorraine Gadbois and Marvella Gamboni from the Historical Commission Council Member Haas removed this item from the Consent Agenda. Marvella Gamboni has served as a member of the Historical Commission since January 3, 2006, and Lorraine Gadbois has served as an Associate Member on the Hugo Historical Commission since May 2, 2011. Both Marvella and Lorraine have submitted their letters of resignation. Haas made motion, Weidt seconded, to accept the letters of resignation for Marvella Gamboni and Lorraine Gadbois from the Historical Commission, and directed staff to prepare Certificates of Appreciation to be presented at a subsequent Council meeting. Approve Recommendation from Historical Commission for $1,000 Donation to the Washington County Historical Society The Washington County Historical Society is requesting donation from all communities in the County for purchase of a building in Stillwater for the Washington County Heritage Center. The Hugo Historical Commission discussed the request at their meeting on October 16, 2012 and recommended approval of a $1,000 donation to the Washington County Historical Society. Haas removed this from the Consent Agenda to inquire where the money was coming from. City Administrator Bryan Bear explained that there is money allocated each year to the Historical Commission's budget, and there is sufficient amount to cover this donation. Haas made motion, Petryk seconded, to approve the recommendation of the Historical Commission to donate $1,000 to the Washington County Historical Society for the Heritage Center. All Ayes. Motion carried. Discussion on Special Event Permits Staff requested a discussion with Council regarding how Special Event Permits are administered by City Staff and the involvement of City personnel in special events. City Administrator Bryan Bear explained that the City had adopted an ordinance three years ago to require special event permits, most of which are approved administratively. Certain events require Council approval such as those serving alcohol, have over 200 people attending, or have amplified music. Larger events, such as the recent Warrior Dash, are more complex and require substantial planning to address impacts to the public's health, safety, and welfare. These events require the involvement of City and Fire Department Staff. Hugo City Council Meeting Minutes for November 5, 2012 Page 5 of 7 The Council discussed how the City should charge for staff and equipment time. Council also talked about whether participation from the Fire Department should be expected or voluntary. Bryan explained the difference between the Fire Department and the Relief Association, who are separate from the City and volunteer their time, usually receiving a donation in return. The Council agreed that staff/fire department involvement in events not sponsored by the City should be paid for by the event holder. Mayor Miron excused Honorary Mayor Jacob Michelson from the dais, and thanked the Scouts for attending the meeting. The Mayor called for a five minute recess. The Council discussed amending the fee schedule to include charges that could be based on whether the event was a non-profit or for-profit event, and the number of participants at the event. It was agreed that the City needed to attract and welcome special events into the City, and the City should be compensated for their involvement. The Council also questioned how often the Fire Department was requested to participate at special events. Staff will continue to evaluate the Special Event Permit process and report back to the Council. No formal action was taken. Update on the Yellow Ribbon Network Council Member Chuck Haas and Council Member Phil Klein reported to Council on the Yellow Ribbon Network (YRN) activities held recently. Council Member Haas presented pictures taken at the Welcome Home Hunt held at Wild Wings on October 20-21, 2012. This hunt is held to recognize the sacrifices of soldiers who miss the regular hunting season while serving overseas. A packaging event is being held on Saturday, November 10, 2012 for care packages to be sent overseas; donations are welcome. The YRN recently assisted a family who was living in a rental unit that was being condemned. The YRN helped a veteran transport their horse to the vet. The next Hamburger Night is November 28, 2012 and is being hosted by the HBA. Flowers will be provided by Leben's Floral. Update on Metropolitan Council Water Supply Advisory Board Council Member Chuck Haas recently attended a meeting of the Metropolitan Council Water Supply Advisory Board and provided an update to the Council. Haas spoke about the discussion on DNR water permits and the conflicting Metropolitan Council's residential requirements. Haas also talked about the studies and data compiled by the Board and the water depth of White Bear Lake. Discussion on Speed Sign on Everton Avenue Mayor Fran Miron was contacted by property owner Dee Davis regarding the speed sign located in front of her property on Everton Avenue and was requesting it be removed. City Administrator Bryan Bear confirmed the sign was in the right-of-way, and information from the sign showed 1-2 % of drivers are exceeding the speed limit by more than 17 mph. There has been increased patrol in the area, and Rick Gwynn, 12277 Ethan Avenue North, stated that it has helped. Council Member Petryk stated the Washington County Sheriff Department can be called with specific times and identification of speeding vehicles, and they will monitor at that time. Hugo City Council Meeting Minutes for November 5, 2012 Page 6 of 7 Rick Gwynn noted that there are two signs very close together, and locations of signs are picked based on solar power needs. Miron made motion, Haas seconded, to direct staff to evaluate where the signs are located and determine if they are in an appropriate place or could be put in an more effective area. All Ayes. Schedule I-35 W/E Coalition Meeting At its meeting on July 12, 2012, the I-35 W/E Coalition agreed to hold their next meeting in early December to discuss the recommendations from the I-35 Corridor Study. The Council agreed that December was a very busy month. Weidt made motion, Klein seconded, to table this item until their January meeting. All Ayes. Motion carried. November 6, 2012 General Election City Administrator Bryan Bear provided a reminder of the General Election on Tuesday, November 6, 2012. There are four polling locations in Hugo: Ward 1 votes at the Hugo Fire Hall, Ward 2 votes at Oneka Elementary School, and Ward 3 votes at the Rice Lake Center. Polls are open from 7 a.m. to 8 p.m. November 8, 2012 Realtors Workshop City Administrator Bryan Bear provided a reminder of the Hugo Realtors Forum on Thursday, November 8 from 9 a.m. — 12:30. This workshop is held by St. Paul Realtors Association and is designed to teach and update Realtors on information regarding the City of Hugo. The Workshop will be held at Hugo City Hall. November 9, 2012 Canvass Board Meeting City Administrator Bryan Bear provided a reminder that the Board of Canvas will meet on Friday, November 9, 2012 at 8:00 a.m. The purpose of the meeting is to certify the results of the General Election held on Tuesday, November 6, 2012. This meeting will be held in the Council Chambers at Hugo City Hall. November 13, 2012 Business NetworkinI4 Breakfast City Administrator Bryan Bear provided a reminder of the Business Networking Breakfast meeting at Hugo City Hall on Tuesday, November 13, 2012 at 7:30 a.m. The guest speakers are Mike Goehner, Edward Jones Financial Advisor; and Paul Christensen, Attorney from Foley & Mansfield, on tools and strategies to help make building, growing, and preserving your business easier. Hugo City Council Meeting Minutes for November 5, 2012 Page 7 of 7 December 6, 2012 Annual Holiday Party City Administrator Bryan Bear provided a reminder of the 2012 Annual Holiday party on Thursday, December 6, 2012 at the Hugo American Legion beginning with social hour at 5:30 p.m. and dinner at 6:30 p.m. This party is held for Hugo's Commissions and Boards in appreciation for the volunteer work. Anyone interested in attending should contact City Clerk Michele Lindau to RSVP by November 21, 2012. Expiration of Watershed District Terms The City has been notified of Watershed Districts' terms that expire in 2013. In order to give cities enough time to recommend individuals for appointment on the Watershed District Boards, the County has provided a list of expiration dates in 2013, and is requesting Council provide a list of nominees to these positions at least 60 days prior the expiration of the term. John Waller, who serves on the Board, thanked the Council for their letter of recommendation on his reappointment. Small Business Saturday on November 24 City Administrator Bryan Bear informed Council the Hugo Business Association will be holding a Small Business Saturday Shop Local Event on Saturday, November 24, 2012. He will provide more information at the next Council meeting. Adjournment Haas made motion, Weidt seconded, to adjourn at 8:56 p.m. All Ayes. Motion carried.
